BANGKOK: THE CONSTITUTION Drafting Commission is considering introducing a lifetime political ban for people who have been jailed and involved in electoral fraud, regardless of whether they receive an amnesty.

The move aimed to raise the standard of election candidates, CDC spokesman Norachit Sinhaseni said yesterday.

The drafters have been deliberating the Parliament section for the new charter. They are now discussing the qualifications needed to run for a seat in the House of Representatives and who should be banned from doing so.

Norachit said candidates who had their political or electoral rights revoked would be banned from contesting an election. But before being banned, he said their cases should be examined thoroughly and their guilt unquestionable.

Only those with minor offences such as defamation would be allowed to run in an election, he said.

But politicians previously banned and whose bans have finished, they would be allowed to run for an MP seat. That would include former MPs from "Houses No 109 and No 111" who were banned for five years.

Norachit said people who have been jailed should be blocked from politics permanently, even if they received an amnesty.

He said the drafters had also been assessing the election process. They had agreed initially that if "no" votes were the majority in a constituency, a new election must be held to get a winner.

But holding a meeting of Parliament was still possible after 90-95 per cent of MPs had won seats, he said.

For constituencies where there was no clear result, a by-election must be held within 30 days, he said.

He quoted the Election Commission when he said the count could be finished within 15 days, meaning it would be no more than 45 days before all MP seats were filled.

Other details about how to set up rules for creating party-lists, how to set up constituencies, how to calculate elections and how to count votes would be stipulated in relevant organic laws, Norachit said.

Before the drafters meeting yesterday, CDC chairman Meechai Ruchupan told the press that senators would now be selected to represent groups categorised as different social forces. Among them could be professional groups and ideological groups.

Their duties and authorities would involve deliberating and endorsing laws and monitoring independent organisations, while the impeachment authority was abolished.

He said that impeachment could not work in the Thai political context. Thais were usually kind and considerate so it was difficult to get someone impeached.

CDC was also looking to improve senators' efficiency by merging the first and second readings, Meechai said. That would improve the flow of work, he said.

In a related development, a panel of charter drafters is set to travel upcountry to gathering comments from people about the constitution. Today and tomorrow they will be in Songkhla.

And on Monday and Tuesday they will be in Loei with representatives from the National Legislative Assembly to attend a seminar entitled "The Participatory Process of Promoting Democratic Leaders".

Norachit - a former permanent secretary of the Ministry of Foreign Affairs who is set to send messages to the international community about the charter draft - revealed that another meeting arranged for foreign diplomats and international organisations might be held in late January after the initial charter draft has been made public.

International friends of Thailand could voice their opinions on the draft and the CDC brief them on its work, he said.

Hogwash. The people doing the impeaching are afraid their closet will be opened and their skeletons will be revealed.

Shouldn't that go without saying, shouldn't it be a common sense and accepted norm?

I suppose even if they pass this and it is accepted, the banned offender will most likely have a proxy put in his/her place, as the Thaksin camp has been doing for all of these years.

There needs to be a clarification. Jailed or found guilty and sentenced. Given the amenable laws in Thailand, 99% of the moneyed/connected MP's wouldn't spend any time in the clink.coffee1.gif

Step three, now that you've effectively banned most of your opposition, have the election.

And, if that's not enough, they've even allowed for the "no" votes winning!

There was a colorful character in the last elected government, affectionately known as "ear medicine man" who probably spent more time in bars than behind them.

Sounds good but too radical and will never happen as it would affect far too many.

I suppose some sort of provision could be included but it would be left so open that a coach and horses could be driven through it to ensure plenty of exceptions to the ban are available. Remember this is a govt that passed a law making it illegal to sell alcohol near a school but without any indication what ' near ' might mean.

I'll tell ya....this place is just plain MIND BOGGLING. e.g. Laws usually NOT enforced; if /when enforced or acted upon "Amnesty" is soon to follow... pardons/ look the other way... want to be "nice" to everyone (including crooks). Seems to reek of codependent personality disorder - nation wide.

If there is NO punishment there is no crime. What you allow you condone.

The most sensible piece the CDC has done, that will stop some from returning after banns of 5 years and letting one particular politician out on bail whilst parliament was sitting, not enough can be said for the Thai tendency of covering up or whitewashing the elite Hi- so of dubious miss deeds, having lobbied for this type of action over decades, this is a very special occasion , one hopes that the rules are set in concrete so they cannot be circumvented , pity it took so long..................................coffee1.gif

My thoughts exactly...what better way to limit your competition...trump up some bogus charge...throw them in jail...never allow them to run for office...this is Thailand...LOS...Land of Scams...

Yes,ban them for life,there needs to be changes in Thailand,

cull the blood sucking politicians,without good people in power,(just hope theres some)

It's agreed the politicians should be banned if they are jailed. The problem is that most never see the inside of a prison and escape that judgement with excuses and apologies and other tactics Thailand allows for people with influence. Unfortunately, this is probably something that will never change so making this law is for show only

quick linking corruption to politics.

bans are just a crude political axe to attack opponents through a biased judicial system and bureaucracy.

If someone breaks the law, give them a trial. if guilty, give them jail time.

if they have served their time, let them run for office again... or do anything else that is normal and legal to do...

Oh dear. I see what you did there : you thought the Junta were doing this so they could then jail all the opposition MP's before the next election so only the ones they want are left ?. Is that as far as your 'vision' goes ?.

Goodness - this politics stuff is all a bit too much for you to get your head around isn't it ?. Let me explain : it is part of reforms to keep proven criminals out of Parliament for future governments.

Lets see how many Pheu-Thai politicians get jailed before the election without good reason. I can tell you now the answer will be NONE. All of them deserve to be behind bars though for grossly abusing their power for personal benefit during the amnesty disgrace. Every one who voted 'yes' should be banned from politics for life IMHO.

The ones who will abuse this law the most are certainly Pheu-Thai. Thaksin is famous for using lawsuits and litigation to get rid of his political enemies. He even uses them to keep his cronies in line and let them know what will happen if they disobey. I remember a story where one of them got on his knees in public and begged Thaksin to withdraw it. That would have made the little goblin feel very good. Sure they will all try it (I said that to help you with this very simplistic view you have on the world) but he will use it as a standard tool in his box.

The best paid job is Thailand is going to be the appeals court. Any politician given jail-time at the first session is going to rush to put his ill-gotten gains into pastry boxes for the appeals court.
