BANGKOK: -- Thung Kham Ltd will today go to the Loei Juvenile Observation and Protection Centre to take legal action against a 15-year-old schoolgirl for her allegedly libellous reporting as part of Thai Public Broadcasting Service’s TV citizen-reporter scheme, according to Thung Kham’s legal department.


The company's official, who asked not to be named, told The Nation by phone yesterday that the case against the schoolgirl was still at the preliminary stage.

The company still needs permission from the Loei centre as well as opinions from other people. This case will require a lot of processes, but the media might be overreacting, he said.

In a statement on Tuesday, ThaiPBS urged the company to review its lawsuit against the girl. Thung Kham had already sued the TV station and other figures for compensation of some Bt50 million and a five-year ban, so the station called on it not to drag the girl into the dispute.

The station said it would cover the legal expenses for the girl if she were taken to court.

Thung Kham, which operates a gold mine in Loei's Wang Saphung district, has been seeking permission from the centre to seek justice from Mathayom 4 student Wanpen Khunna.

Since the law requires those wishing to file a criminal complaint against a minor to obtain permission from a juvenile observation and protection centre first, the company on November 27 sought permission from the Loei centre.

The Loei centre summoned Wanpen and her parents for questioning on December 21 to determine if there were grounds for the firm to go after her legally.

Wanpen joined ThaiPBS's camp from August 28-30, when she helped with the production of the TV report, which aired on September 1.

They rushed into setting out their stall because of face and now will probably hope the juvenile authority refuses permission to go ahead so they can save face having been handed a reason not to pursue the ludicrous decision to sue a 15 year old and without having, or being forced, to back off.

We should also stop serving the company execs in restaurants, selling them equipment, gas, educating their children....

I can't find out much about who owns this company. Would be interesting to see what sort of parasites would sue a 15 year old girl on a Seinfeld issue.

I hope this mobilises the Thai population into demanding that this idiotic system persists where you can be jailed or fined for libel and defamation when you are telling the truth. It was an extension of the law granted to ensure politicians could enjoy the privilege of immunity despite being corrupt lying scumbags.

Thailand cannot move on until these laws are repealed.

Only the intellectually retarded would consider suing this girl as saving face as opposed to losing it.

Except that... there isn't much face in Thailand to be lost. The only people who think Thailand has any integrity are deluded Thais.

Absolutely, these medieval laws are for the sole purpose of protecting the corrupt from accountability, it's insane that in 2015 people are suppressed by laws that protect rich people.

This is why the high ranking Military and Police are so blatantly corrupt, everybody knows they cannot obtain the massive wealth in a legitimate way, everybody knows they are massively corrupt, so they create laws that protect themselves from criticism.

And the only people that can stop them, won't stop them, because they need these people to protect them from the oppressed masses, they control the guns.

It's funny how farang think saving face is only an issue for Thais and can't see how much worse it is for farang at home or abroad.

Most of the school and work place mass shootings in farang land are a consequence of someone believing that he/they have lost face. Road rage, largely a western issue, is almost always a consequence of some farang having his ego damaged. And a large number of the seemingly endless rants on Thai Visa are predicated on matters of "principle" ... which is farang-speak for perceived loss of face when some immigration officer or store clerk or any random Thai didn't genuflect properly when handling Khun Farang.

When it comes to frivolous litigation generated by loss of face or bent egos, farang land is miles ahead of Thailand. In farang land loss of face and emotional trauma can be devastating.

A McDonald's customer is suing the fast food restaurant for $1.5million because he was given only one napkin with his meal.

Webster Lucas claims he is now unable to work because of the 'undue mental anguish' and 'emotional distress' caused by the incident.

In predictable fashion your post degenerates into the non-OP related happenings in other parts of the world. It seems you have no issue with the use of the Thai Defamation laws, as you have made no reference to them and the theme of the OP in this thread. Please clarify your position on this so that I can understand what your thoughts are in relation to the OP.
