A friend of mine married with Thai lady but no registered marriage, has 3 kids already registered with his name,

His work permit most likely will expire in middle of Feb 2016, he is planning to go to Kuala Lumpur to get Non-O visa,

does he need 400k in his account? or else?

if his marriage is not registered, is there any other option to get this according to his kids registered under his name?

Kindly we need accurate information from someone done the same procedure,

this is very important to tell him accurate information that he will follow, he never applied for Non-o before, as myself too,

we have no any idea, if any additional suggestions, will be highly appreciated,

  • Your friend is not married, therefore, does not qualify for any visa or extension of stay based on marriage, but he could get a visa and possibly a 1 year extension of stay as a parent.
  • If he needs time to organise a trip to get a new visa, he can get a 60 day extension of stay on the basis of visiting his children at an immigration office for 1,900 baht. That could be applied for when the WP finishes.
  • KL is one of the worst places to get a visa. He should go to Penang or Laos.
  • He can get single entry non 'O' visa with just a childs original birth certificate. That gives a 90 permit to stay on entry. That stay can be extended once for 60 days with a birth certificate. It can also be extended for 1 year but only if he is the legal parent. Being named on the birth certificate or having his name does not make him the legal parent. That has to be by a court or, if the children are old enough, at the local Amphur. See info here.

I suggest he goes to Laos or Penang for a single entry non 'O' visa on the basis of being a parent. He should also legalise his parenthood. Then during the last 30 days of the non 'O' entry he can apply for a 1 year extension of stay. To apply for a 1 year extension he will need 400k in a Thai account on the day of application or a certified minimum income of 40k pm.

Requirements or the non 'O' visa,

  • Visa application form.
  • The original birth certificate plus copy.
  • A signed copy of the mothers ID.
  • A signed copy the mothers house book (Tabien Baan).
  • Copy of the child's house book.
  • A copy of passport photo page.
  • 2 x Passport photos.
  • 2,000 baht

As already posted, your friend is not eligible for a Non Immigrant 'O' Visa based on marriage without formal papers.

Children with Father's name on the birth certificate also need to have the Father 'Legalised' - with a Thai Court process required if the kids are under 8.

A one off 60 day extension of permission to stay, at the local Thai immigration department, based on visiting children is possible.

KL is now the absolute worst choice in SE Asia for non immigrant visas - they are super picky and most unreasonable.

Single Entry Non 'O' s can be obtained as the parent of a Thai child with the children's birth certificate at Vientiane or Savannakhet.

Other consular facilities may refuse.

He could get a multiple entry non-o visa in Penang if he has at least 100k baht in the bank or proof of income with just his name on the birth certificate.

Savannakhet will do one with no financial proof if the entire family is present when the application is done as proof that they are living together as a family (de facto marriage).

I suggest that he and the mother visit their local Amphur. They will advise exactly what's required and whether the Amphur or court will deal with the case.

I learned from him about his children ages range between 10, 7 and 4,

for 100k is available in his account, besides his own car worth around 500k, motobike, portfolio in SET etc,

He needs only one single o-enter for this moment, within this 90 days he has some new arrangements,

He only needs to be legalised as the parent of one child to get an extension of stay and the Amphur should be able to do that for, at least, the 10 year old. Obviously he should do the same for all three children, but if pushed for time having a 10 year old works in his favour.

He doesn't need the 100k for a single entry non 'O' visa. That's only needed for a multiple entry.

The legitimization of his 10 and 7 year old children can be done at an Amphoe. The 4 year old would probably have to be done through a court.

Getting a 60 day extension to visit his children is also an option.

Thanks for all the replies guys,

My friend told me that he decided to get just one single enter "Non-O" he booked his flight tickers to KL already, even I advised him it is not the proper destination to go for to apply for this visa, however it was booked since last month he said was so cheap promotion,

then will do the court process for legalize his children during his next 90 days staying visa,

for this single Non-O, he said that he has over than 100k,

does he need to bring a statement letter from his bank?

also he mentioned to bring his car blue book, and other relevant for his assets. besides his children bith cert. and their Thai passports his wife ID card, to take all copied and original ones, in case the embassy in KL we ask for solid prove, as I heard from some comments is a tough one,

However, the current priority for him is to obtain this single enter, if any of your done this recently in KL particularly, kindly update to share what is necessary to be arranged to facilitate the process and avoid any time wasting,

As well if any places to visit in KL, he will stay a week, any advises to recommend?

  • Yes you can get a multiple entry non 'O' visa based on marriage with at least 100k in the bank.
  • The visa is valid for 1 year from the date of issue.
  • You need to exit every 90 days or apply for an extension of stay.
  • 60 day extensions of stay are available once for every 90 day entry. 1,900 baht.
  • If you enter just before the visa expires you will be granted a 90 day stay, which if extended, gives you an extra 5 months. This gives a toal stay possible of nearly 17 months before needing to go and get a new visa.
  • A 1 year extension of stay can be applied for during the last 30 days of any 90 day entry as long as you have 400k in a Thai bank of a certified income of 40k p.m.

The same visa is available from Savannakhet, Laos without any financial proof.

It is the same to get a multiple entry non-o visa based upon marriage. The visa is valid for one year but only allows 90 day entries. You have to leave the country every 90 days to get a new entry. Savannakhet will issue one with no financial proof.

No need to legalize the father in a Thai court.

I have not done it YET and still get my one year None-O-M from either Singapore or Germany. For the OP the home country would always guarantee him a None-O-M visa for a year which can almost been used for 15 months plus it could be extended for another 60 days.

He means a non 'O' multiple (M) entry.

He means a non 'O' multiple (M) entry.

KL are reported to want 400k in the bank even for a single entry. http://www.thaivisa.com/forum/topic/866845-report-non-imm-o-appl-thai-cons-kl/ So I would recommend having at least 400k or go to Penang.

You apply in the morning of day one and collect the visa in the afternoon of day two.
