Hi,

My and my girlfriend are both from Europe, middle of 20's and have just been blessed with a baby girl while staying in Thailand on Study ED VISA. We don't know who to ask these tricky visa questions other than this forum since they don't even know the current rules at our H1 counter at Chang Wattana due low English level.

1) Is there any benefit with Thai visas because of our baby girls Thai birth certificate?

2) At what age do we need to get any kind of VISA for our baby?

  1. You cannot get a visa in Thailand. You will need to apply at an embassy/consulate in a neighbouring country. She can get a tourist visa or possibly a non immigrant visa/extension of stay based on the parents visa/extension of stay.
  2. All foreigners need a valid permission to stay. Your baby is currently an alien staying in Thailand without permission. But as it stands Thai immigration do not apply penalties to children under 15. That said, if you're planning to stay long term you should make her status legal.

I think the first thing to do is to get a passport for your daughter, for her nationality, as that is important for when you leave/enter another country and to apply for a visa.

1. A non-o visa and an extension as your dependent would be possible.

2. There is no minimum age to get a visa. Children under the age of 15 do not pay overstay fines but do get a stamp for it.

Her passport is first priority, no doubt, but since we're not working here and not old enough to get retired VISA, our only option is to get her on arrival visa exception and simply overstay and hope for no fines later on? I really don't see any other solutions for her now as 3 month old? We are not leaving the country for now, but will be visiting our home countries within the next half year.

I don't want to break the rules, but please enlighten me if there is a more simple way to have your infant with you here.

As I wrote you child is legally here at this time since she was born here. When you first take her out of the country you will show her birth certificate and passport on departure from the country and they will stamp her out of the country without a problem.

All the immigration rules and regulations are based upon entering the country as a foreigner.

If you are studying here and on a extension of stay your child can get an extension as your dependent. To do this you will need to get a single entry non-o visa for them while you are back in your home country. You will just need to show your her birth certificate and your passport showing your extension of stay stamp.
