I'm plan to change from a Non-Immigrant Visa to a Non-Immigrant Visa "O", I just want to see if a have a problem, my company terminated my employment and contract when I was 60 last October. They then gave me a 6 months contract that runs out 30th April 16, I understand I ahve to apply for my Non-Immigrant Visa "O" on this date. Do i have a problem with my termination letter being in October?

with best regards

Colin

They should be able to give you another termination letter at the end of the new contract.

You apparently are wanting to apply for an extension of stay (it is not a visa) which I assume is for retirement. You would be changing the reason for your extension for working to retirement I also assume. The termination letter would have to be dated on the date you do the change so immigration can cancel your current extension,

Many Thanks ubonjoe

Yes i would like to extend the non imm B (business) to non imm O (marriage).

I'll check with my company, I think the reason they issued it when I was 60, is becasue its the retirement age in Thailand,

with best regards

You will be changing the reason for your extension of stay. If you ask about changing from a non-b to a non-o visa they will tell you no because it cannot be done.

Ok many thanks, I thinking I'm getting there

If I'm not changing the visa, does that mean the visa will only last for the length of the existing visa? Or do I get a full 12 months?

Also as I was not expecting to have to renew the visa so soon and my funds will arrive just in time for the application, but at that time I expect to everything in place and ok, but happens if they find a small issue with the application? Do they contact you and give time to correct it? What is the protocol? I can probably arrange for funds sooner, but that has a cost.

Your current extension will be canceled and then you will be given a new one year extension based upon marriage.

You will need to meet the financial requirements for the extension based upon marriage on the date you do the change. They are 400k baht in a Thai bank in your name only for 2 months or proof of 40k baht income,

If if you have problems getting the one year extension you could apply for a 60 day extension to visit your wife to get some more time.

My non imm B visa ends in Aug, but I leave work April, (when I want to switch to a Non imm O) even so I can apply for a 60 day extension in order to have everything in place, a sixty day extension would be good because as said my pension payment is badly timed and this will reoccur every year.

How do I go about making a 60 day extension? What forms do I need etc etc

You would need the termination letter to cancel you current extension and the following.

You will need a completed TM7 extension of stay application form.

Your wife will need to be with you when you apply.

Your marriage certificate and a copy.

Copies of your wife's house book registry and ID card.

Suggest you re read what UJ has been telling you.

If you want an "O" visa you will have to apply for one at a Thai Embassy/Consulate in a nearby country.

A TM7 form is required to apply for an extension at your local immigration office.

I think I asked the wrong question I have non-immi B visa, and want an extension based on non-immi O visa, which I understand is possible.

Wrong but never mind !

As suggested before re-read what UJ has been patiently explaining.

You don't have a non-b visa unless you are leaving the country every 90 days for a new 90 day entry. You apparently have an extension of stay based on working that can be changed to one based upon marriage.

An extension of stay is not an extension of a visa.

Most likely you entered the country using a non-imm B visa but then were here based on an extension of stay related to your employment and the visa will have long since expired.

If you want a non-imm O visa, you'd need to get it from an embassy or consulate, not immigrations, but you don't really need a new visa.

What you apparently want is to change the reason for being granted an extension of stay from immigrations from being based on working to being based marriage which can be done without changing or getting a new visa.

More pointedly, forget non-imm B and non-imm O and focus on the basis for the extension ... from work to marriage.

Ok, so I need to apply for "visa extension based on marriage" or visa extension based on marriage, to be with my wife child and family".

You need to apply for an extension of stay based on marriage rather than your current extension of stay based on work.

Immigration cannot extend a visa but can process change or extend an extension of stay.

Can one also change the extension of stay based upon work to one based upon retirement without a new Visa ?

Yes

So you can change an extension reason without getting a new visa? Even if the category is not covered in the original visa? E.g. work visa (non-B) to marriage visa (non-O)

Regarding the 60 day extension, your other post suggest the process is the same as "extending my visa by marriage" if I have to apply the same burden of documentation, such as financial records etc, it does not help me, I just as well go for the one year extension. How do the two differ?

Here is my other post about the 60 day extension. No mention of financial proof.
