andreww Posted March 2, 2016 Posted March 2, 2016 Folks, Going through a rough year of r/ship with my Thai lady, not looking for divorce YET, but just in case it happens.. Is there any way to guarantee my custody over our child in case we divorce? We're on reasonably good terms right now, and wife does not mind if I take care of our kid, so I want to seize the moment and make it legal & binding before sh#t hits the fan and she changes her mind once again... We had no prenup signed (my bad, I know, never again , and AFAIK, postnups are not binding in Thailand. Any other options? (apart from keeping all kids' documents away from her, which I will do). Thank you.
sunnyjim5 Posted March 2, 2016 Posted March 2, 2016 You cannot "guarantee " custody in advance of a divorce. If the divorce is uncontested then custody arrangements/agreements can be made as part of the Amphor divorce process. If a contested divorce the court will decide, in the child's best interests, the custody arrangements. Be aware your wife, as the child's mother, always has the right to challenge any decision/arrangement made concerning her child.

blackcab Posted March 3, 2016 Posted March 3, 2016 Be aware that nearly all contracts between spouses can be cancelled by either party at any time during marriage or within 1 year after a divorce.
