BANGKOK: --- The State Audit Commission has decided to ask the National Anti-Corruption Commission to take criminal litigation against former finance minister Surapong Suebwonglee, former PTT managing director Prasert Boonsamphan and a few other ex-officials of the Finance Ministry and PTT executives for alleged malfeasance in office regarding the oil pipeline system.

Auditor-General Pisit Leelawatcharopas told the media on Tuesday that the State Audit Commission agreed with the findings of the Office of the Auditor-General (OAG) that the return of the pipeline system by PTT Plc to the state did not comply with the ruling of the Supreme Administrative Court.

He said that the PTT’s report to the Supreme Administrative Court regarding the assets to be returned to the state did not include the offshore pipeline worth about 32 billion baht.

The offshore pipeline which is regarded as state property should have been transferred to the state as October 1, 2011 but it was not returned to the state hence depriving the state of revenue which should have gained.

Mr Pisit said further that PTT had covered up facts about offshore pipeline system which should have been reported to the Supreme Administrative Court and the cabinet.

PTT claims it has fully complied with the court’s order and the cabinet’s resolution regarding returned assets

BANGKOK: -- PTT Plc announced on Tuesday that the company had returned all the assets which belong to state, including the pipeline system, to the Finance Ministry as ordered by the Supreme Administrative Court.

Mr Chavalit Panthong, chief operating officer of the infrastructure business and sustainable administration of PTT Plc, confirmed that the company had fully complied with the court’s ruling as well as the cabinet’s resolution.

He claimed that the Supreme Administrative Court had issued several orders proclaiming that PTT Plc had properly complied with the court’s ruling regarding the state assets which were to be returned to the state.

He cited the court’s latest order on April 7 rejecting the Consumers Foundation’s petition for the court to revoke the Supreme Administrative Court’s ruling on December 26, 2008 that PTT could not return to the state assets beyond those ordered by the court.

PTT, said Mr Chavalit, worked with authorities concerned regarding the separation of assets in compliance with the cabinet’s resolution. A report about the matter was sent to the cabinet and there was no objection from the cabinet, he added.

He insisted that the separation of assets was in line with the court’s ruling and with the cabinet’s guidelines without any shortcut as suggested by the State Audit Commission.

We have conflicting interpretations on what is separation of assets , one wonders why an agreement was passed that excised the off shore pipe line from the rest of the assets and just in whose private hands did it go to, summing up this mess , it seems a little late in the day to press charges , and it could be assumed brown nosing or grandstanding on the back of the Junta band wagon , however if it is the state's property it should be handed back........................... coffee1.gif
