Government to demand 20 billion baht compensation for damages in fake G2G rice deals

BANGKOK: The Council of State has recommended that the prime minister can issue an administrative order to demand compensation for damages inflicted by the fake rice deals with China to the state, according to Ms Duangporn Rodphaya, director-general of the Foreign Trade Department.

She said the recommendation would pave the way for the prime minister to issue the administrative order soon to detail procedure in demanding compensation amounted to 20 billion baht from six politicians and government officials for the damages inflicted by four fake 6.2 million ton G2G rice agreements to the state.

She said that it was expected that the prime minister would sign the order and the procedure would not take time.

She said if the order is issued, the department will then notify the six persons.

They can appeal the administrative order through the legal channel, she said.

She said the order carries a two-year statute of limitation.

She didn’t name the six persons but it was known that ex-premier Yingluck Shinawatra and former commerce minister Boonsong Teriyapirom were held responsible.

Meanwhile the government will auction off another lot of 1.63 million ton of rice.

Interested bidders will allowed to inspect the rice stocks at government warehouses from July 11-15, and they are required to submit tenders on July 25.

So I guess the 6 will be going on a 2 year vacation.

Hopefully the administrative order will detail the cause and evidence justifying the demand for 20 billion baht compensation. To date I've not seen any details from any source that justifies such demand for compensation. Of course an administrfative order is not a judicial order and as such, it needn't conform to any standard of legal justification.

Neither does it need to justify anything to Thaivisa posters and because you haven't seen any details means

nothing.

well instead of posting that on here why don't you contact the Council of State and find out why you weren't kept in the loop

20 billion baht in damages, ok so what were the damages?

Who suffered from the so-called damages?

Who will be on the receiving end of the 20 billion?

Now correct me if I'm wrong, but was the problem regarding "fake" g2g rice deal was that there were one or two buyers that were unauthorized by the Chinese government to buy rice but other buyers were authorized to buy rice?

So is the junta trying to prove that Thai ministers knowingly tried to make a deal with the Chinese unauthorized buyers or did the Thai ministers try to hide the fact that the some of the Chinese buyers were not authorized by the Chinese government?

Also Yingluk was a wear that some buyers were not authorized and didn't stop the deal from going ahead and that caused 20 billion baht in damages?

Wow junta huggers must be so proud, Dems can't win an election so have yet another coup, accuse opposition of any trumped up charges they can think of, ban them from politics for X years, make up provisions to financially destroy political opposition and if people protest throw them and their mothers in gaol for what ever you can think up.

Go for it, Gen "PM", Sir! And when you and the rest of your band of <deleted> are thrown out I'll look forward to the next government having a close look at your finances!

What's that? Amnesty??? Well, I never!!

I have explained this before to you.. but you love to forget

The problem was that the companies were not authorized and there for could not get the rice at the discount price (they could only sell rice under the purchase (high) price to other countries not private traders). However, this was just the beginning of the fraud.. the rice was never delivered and on paper sold back into the rice program.

Get it now.. sold on paper for a cheap price and then sold back in the system for a higher price.. pocket the difference PTP. This has been explained in the news at the time of the scam.

If they were authorized traders and the ride was then sold at local market in China there would not have been any problem (and no way to skim money) That is why they always say that the traders were not authorized.. otherwise it looks like China was in this scam too.

*EDIT (I Knew i should have saved the diagrams printed in the newspaper to explain it to those who could not understand i)

This is to assure that the Thaksin family will not be heading the government of Thailand again ever.As for the present PM being held responsible it wont happen as the new Constitution will be written in such away that will exonerate him for his actions using Article 44 and imposing other laws..

During all coups a new constitution is written exonerating the people or persons's actions during their tenure in office while in the pretense of straightening out the country. The PM actions at this time is to assure that the Thaksin family will never again lead Thailand.

It's correct that the rice was never delivered to the Chinese because there wasn't any deal from the beginning. It is not about authorised or unauthorised buyers, it's all about fake deals that never existed. They took stock out of the silos with the low prices and then sold it back to the silos and markets with higher price because they exploited the fake G2G deals.

Well Shin lover boy, you're wrong again.

The problem was that the accused, and they are facing a trial on this, appear to have entered into a fraud. The scam was that the Chinese companies pretended to order rice for export to China. The paperwork was processed and the Thai selling organizations bought the rice at the much lower price allowed for export only. But the rice never went anywhere. The Chinese companies didn't really buy it, it was never exported, but the Thai companies simply re-sold it on the home market back into the rice program thus making a much bigger profit for themselves than had they bought it from the government based on the home market price. Bought it from the government at cheap export price, sold it back to them at higher pledge price. Clever - but not clever enough as it relied on them being in power to make sure it never came to light.

Now there will be the loss of profit, the cost of investigating and sorting out, damage to reputation, interest etc etc in that calculation. Presuming you don't agree with letting the crooks off, if they are proven guilty of course.

Yingluck repeatedly stated that she and only she was in charge of her government. So yes, any buck should stop with the person in charge should it not? She said she was doing the job. Moreover she appointed herself head of the rice program and as such was clearly responsible for insuring everything was above board and any issues thoroughly investigated and dealt with. Of course how she managed to do that without even bothering to attend any meetings she was supposed to chair is a mystery - which she will no doubt explain during her in progress trial. Also she did claim she new about G2G rice deals with China but said all the details were secret. Wonder if this is the reason for the secrecy?

The Shins though, believed, themselves above the law, destined to be in power for a long time so they could ensure all this could be swept under the carpet, Reducing checks and balances, cutting budgets of NGO's, threatening, sacking, intimidating those who dared speak out. It's all there - just get off your arse and do some research if you really want to know,

But you Shin lovers just hide forever behind "they were elected". Yes they were, but that didn't mean they were above the law, could do as the pleased, allow their mates to do what they like and then just shrug it all off with some fairy story.

Chickens coming home to roost - and no longer have tame DSI, police or AG to protect them.

Not at all. All criminals irrespective of political affiliation should be prosecuted, and that includes those who have given themselves an amnesty.

You may have confused my first link with some of your favorite sex sites.

First link is to a news organization that cannot be identified in the forum. So I have replaced its name in the link with "x" 's. PM me and I will give you the full link if you can't figure it out from counting the number of x's in the link.

In a western courthouse with real judges and not appointed judges. You need to proof if somebody did something wrong. No proof then <deleted> off.How they can demand even one baht? They kicked out Khun Yingluk,so there was no way for her to sell more rice or try to lower the loss. The junta is still cashing in from the rice scheme, will they later deduct all that money from 20billion?

Wow, lots of the Junta cheerleaders making a rare appearance in one single thread !!

How many Millers and warehouse owners have been held into account and how many have been tried and convicted for their part of the scam?

It's nothing more than political statements that comes from the Junta these days, how's that reconciliation going on these days ?
