Hi, short and sweet. If a Thai national adopts a foreign child does that child have any rights under Thai law. ie. can the Thai national bring the child to live in Thailand etc etc etc. Thailand is a member of the Hague convention i know but everything we have researched seems to be around adopting a Thai child not the other way around. Ive search many sites including this and only found mombo jumbo and nonsense to be honest. If you dont know dont comment. Thank for your imput in advance

As you are probably aware, Family Law is mainly codified in the Civil and Commercial Code. There is a lot to wade through, but the most important section, I think, is this:

Section 1598/28. An adopted child acquires the status of a legitimate child of the adoptor, but none of his rights and duties in the family to which he belongs by birth are prejudiced thereby. In such , the natural parent lose parental power, if any, from the time when the child is adopted.

 

I think, certainly in the case of a minor child, the adopted child becomes a Thai citizen by descent.

 

I am really curious, having read Chapter IV (Adoption) of Section 1598 whether (as seemingly implied) an adult could voluntarily be adopted by a Thai (at least 15 years older) and automatically become a Thai citizen in the process!

 

I assume you are just doing some preliminary investigation of your own, and are intending to talk to a good lawyer before making major decisions.
