Hello ALL!!

 

This coming month I am going to apply for an extension of stay (1 YEAR), on my Non-O Visa, due to marriage. This is not my 1st one but, it is also not a consecutive, marriage based, VISA/Extension. I have a few questions. My passport expires 2017 in February. Do I need a new passport before the extension application? I'm guessing yes. I also have a paper from my embassy that Is about 60 days old. Should I get a New one? I seem to remember something about 30 days... this one might be too old. Finally and probably the most difficult to answer; Me and my wife live in a friends condo. We have no contract with the condo owner. Is the contract a requirement to show cohabitation?

Are you now on a non-o visa entry? That will be needed to apply for the extension of stay.

You will need a new passport or your extension would only be done to the date your current one expires. 

A proof of income from an embassy that is up to 6 months will be accepted by immigration. But a problem that could arise would be that it was issued with your old passport number on it and I am not sure if immigration would accept it.

You will need proof of residence for where you are living. Normally a rental agreement with signed copies of the owners house book and ID card attached to it is needed. Does your friend own the condo or are they renting it?

Definitely get a new passport before you apply for your new extension. Otherwise this would only be granted for a maximum of 6 months up to the expiry date of your existing passport next February, and you would then have to start all over from scratch with a fresh annual extension application with your new passport.

 

I assume that the "paper from my embassy" to which you refer is an income confirmation letter/affidavit. If so this is valid for 6 months from the date of issue.

 

If you live in a friend's condo I suspect that a formal letter from him/her confirming that you live at his/her address (along with copies of his/her ID card or passport and relevant house book) should suffice for Immigration's purposes, and he/she would also complete the TM30 form as the house master should Immigration require this. But this is subject to the advice of others who may be more in the know than I am on this particular point.
