It's one soundbite from one guy in Phuket (known to be a bit stricter) but there's still no actual official policy in writing, and so far it's unheard of for digital nomads to be arrested.  And it's not possible to get a work permit and 'get legal' / pay taxes doing what they do anyway.

Its very possible to get legal, theres BOI companies specifically set up to employ online workers, get them visas, get them work permits, handle the whole thing.. Exactly what nomads constantly say 'if only there was a way to be legal I would be happy to pay' then they are told there is a way, and suddenly the cost is too much.

Most tourists here would be guilty of working illegally as they would be answering work email daily, hence 'working' here.

This is no worse than some blogger living here as far as the law is concerned.

The law needs to be clarified.

The best way to get said law clarified?

Email your embassy and recommend that they add a travel advisory for visiting Thailand warning tourists that they risk imprisonment if caught doing anything construed as work such as fielding phone calls and email from the office back home.

Also California just legalized marijuana.. I would hope the 30 million californians who might consume marijuana are warned by their government that they will be jailed if randomly drug tested even if no marijuana was consumed in Thailand.

These laws need to be clarified and the best way to force clarification is for these issues to get international media attention.

I've seen you link that too before. The reps there seem to think the question is about performing work that has a physical presence in Thailand. They say in their answers 'starting a business in Thailand' and 'doing business online'. This also seems to leave out / contradict your other link where the rep said that turning on Youtube adverts before coming to Thailand would not be considered working. At least, they don't mention passive income at all - advertising and affiliate marketing (as per the question) is often passive income. 

 

It's really still not clear at all, it's just some quotes in a Phuket magazine. It's not 'denial of the facts' when that's all you can come up with in the history of these debates (been going on for a decade on Thaivisa and still no one ever got arrested for blogging), these two links. Facts would be actual clarified laws, arrests, etc. In fact bloggers / online workers were mistakenly arrested as police though they were working for the coworking space (Punspace in Chiang Mai) and then all released when police realised they weren't. They didn't seem to consider their online activities

'working in Thailand'.

 

There are still hundreds of online workers sitting in co-working spaces today, why aren't they being rounded up. There are facebook groups of 15000 digital nomads, whole summits where they meet up, nothing happens. There are many anecdotal reports of people asking the Thai authorities where they stand and being told mai pen rai.

 

I know about the BOI companies too. Iglu for example - but you need to work in specific fields, have specific degrees plus 2 years work experience, a Youtuber or blogger would not qualify, so it doesn't apply to me. If it doesn't apply to me then it isn't 'very possible', and I'm not ignoring 'the way' because 'the cost is too much'. If it applies to others then great, I'm sure they're already aware of it. 

 

You claim that people simply are in denial because they don't want to pay taxes, I'd retort that some on the other side of the argument are coming to their own conclusions out of jealousy.

As to the jealousy thing.. Of some backpackers with a smartphone ?? Really ?? I retired a multi millionaire the first time at 28 after 5 years of work.  I have since launched other businesses including one this summer, confident it will make 7 digit money in 3 years. What is there to be jealous of exactly..

Interpreting Thai labor law and advising us in the forums also requires a work permit since you are volunteering your time to educate digital nomads.

Which lawyer did you use to get the appropriate volunteer work permit?

What if I enjoy teaching poor village children english as a hobby with zero renumeration?

Why is your scenario any different?

Both parties require work permits since they are volunteering their time as per the law.
