NCPO changes statute of limitation application for fishery law

 

BANGKOK, 29 December 2016 (NNT) – The National Council for Peace and Order (NCPO) has ordered that the statue of limitations for suspects evading arrest in cases to do with fishery law violations not begin until they are in custody to avoid violators running down their case’s clock. 

Director of the Department of Fisheries’ Legal Affairs Division Prates Sorak revealed that due to current laws setting the statute of limitations for crimes that only constitute a fine at 1 year, many suspects of such cases have chosen to evade arrest and wait out the time limit. He pointed out that of the over 2,000 cases that fall within the parameter, a disproportionate amount see suspects not reporting to hear charges and a large amount reaching their statute of limitations. 

In response, the NCPO has mandated that the statute of limitations in such cases will only begin once court proceedings begin. It has regulated that time spent evading authorities will not be counted as part of the limit. 

Prates assured that proper utilization of fisheries laws is an important part of Thailand’s effort to combat illegal, unreported and unregulated fishing.

That is an interesting change to the law.

 

i wonder if it will only apply to the unregulated fishing industry, or perhaps become part of the regular laws applicable to everyone?

Yeah, a few other statutory limitations come to mind. Great work. It seems the mechanics of the law enforcement cannot handle the job, when it chooses.
