Govt not to invoke Article 44 in Rolls-Royce fraud case

BANGKOK, 30 January 2017 (NNT) – The government won't resort to Article 44 of the interim constitution to speed up the investigation into a bribery case against Britain’s Rolls-Royce, saying normal legal procedures will be followed. 

In response to the criticism that the investigation into alleged bribery by Rolls-Royce involving Thai Airways has not made much progress, Lt. Gen. Sunsern Kaewkumnerd, the Thai government spokesperson, said the government understands well that the scandal has put a spotlight on the government, but it also understands that it is important to respect and strictly adhere to standard legal procedures. And for this reason, the government will not resort to Article 44 of the provisional charter to accelerate the investigation. 

He said the National Anti-Corruption Commission and the Office of the Auditor General are already working on the case and there is no reason for the government to interfere. 

He went on to explain that Article 44 is imposed only under specific circumstances such as when a problem cannot be fixed by the law.

As in: when no crime has been committed, but you really need someone in jail.:blink:

Article 44 was used to speed up the subway link to bang sue....it's delayed again now...so it doesn't work.

 

Better use it to taxi using their metres and lotterytickets have a fixed price, even that doesn't work.

Article 44 usage seems erratic, capricious and focused on both the most mundane things (lottery, street racers), and the most vitally important issues (stripping someone of his police rank).

 

The amount of time the Junta spokespeople are spending trying to unwind these corruption cases is almost laughable. Could you imagine if a Shinwatra was somehow implicated? OMG, they'd blow their whistles dry.

Using the Article 44 would show all the top military generals on the bribe list and they could not have that. This was a stupid act on both the Rolls-Royce agents doing the bribing and the government officials .The way Taksin did it was to form a company in Taiwan, having them buy the units at a normal price then charging the LOS government a price at triple the price .Then keeping the overage of money for his family.

September this year it will be operational.

 

They should use article 44 here to lift the statute of limitations. Bad Show PM.

Thaksin was quite a bit smarter when he was hiding his corruption, I dislike the guy but he was far more devious. I do hope some generals get caught..doubt it.. but I can hope.
