Equality group files complaint after Korat school bans LGBT pupils

ENFORCEMENT of the Gender Equality Act is still insufficient as the law has many loopholes that discourage the prevention of gender discrimination, an LGBT group has said.

 

The Togetherness for Equality Action (TEA) group expressed concern after a gender discrimination committee rejected a petition by TEA to investigate Tawanchai Wittaya School in Nakhon Ratchasima over an admissions rule that bans lesbian, gay, bisexual and transgender students.

 

Chumaporn Waaddao, a TEA member, said she was disappointed that the committee refused to review Tawanchai Wittaya School’s policy on the grounds that her organisation had been unable to identify particular individuals harmed by the prejudicial policy.

 

“We were told that our petition to the committee was incomplete, as we could not find anyone who was disadvantaged by the school’s admission rule. But it is very obvious that the rule is discriminatory against LGBT people, as the school denies this group of people the right to study,” Chumaporn said.

“An investigation into this issue is in the public interest, because the school’s rule disadvantages the LGBT community as a whole, not just individual victims. Moreover, most victims of such discrimination in a conservative society are too afraid to publicly identify themselves as LGBT.”

 

She said the experience made it clear that the Gender Equality Act had problems. First, she said, the law failed to encourage gender equality and prevent discrimination. Second, the law had loopholes that made investigations into gender discrimination ineffective. Supensri Pungkoksung, a member of the gender discrimination investigation committee, said the panel acknowledged the problem at Tawanchai School. It also conceded that the Gender Equality Act was not perfect and needed to be improved.

 

“The committee does not have any power over the act and we have to follow the rules. The case request for Tawanchai Wittaya School was incomplete, so we could not investigate the issue even if we wanted to,” she said.

 

Supensri said the TEA Group should find another agency to help address the issue, such as the National Human Rights Commission, which could investigate rights violations immediately even without a complaint from a ‘victim’.

 

Supensri admitted that the Gender Equality Act was quite new, so further improvement of the law was needed to better protect the rights of all people regardless of their gender or sexual orientation.

 

“We still have to work hard to prevent gender discrimination and we admit the complaint from the TEA Group calls for improvement of our duty in the future, while the promotion of gender equality is a task for the Women’s Affairs and Family Development Office,” she said. 

 

“I have heard that they are working hard to change the mindset of people to embrace gender diversity and equality.”

 

Meanwhile, Tawanchai Wittaya School principal Saiwarun Sompong said the school banned non-heterosexual students from attending because it was a boarding school.

 

“We do not accept LGBT students because we are afraid that we cannot take care of them well. We are a boarding school, which separates clearly between male and female dorms. If a student is homosexual, they could face trouble adapting to the society here,” Saiwarun said.

 

Another reason, she said, was because the school had a religious basis and aims to produce students with “good morals”, according to Buddhism values.

 

“We are open and ready to teach everyone, but we fear for the students’ well-being, so LGBT student can register with other schools that suit them more,” she said.

 

Meanwhile, Ratchasima Wittayalai School, also in Nakhon Ratchasima, reportedly compiled a list of male students who were |“sexually deviant”. School principal Boonlert Phuangphet said the list was only to enrol targeted students |for “personality improvement |programmes”, adding that names on the list were kept strictly confidential.

If they'd been banned by the school, it already would be public. As for a conservative society, this is the same one that sees katoys as an acceptable, if not a normal, part of Thai society.

Half would be an exaggeration but clearly 20%-ish of the females and 30%-ish of the males would be banned. I also find it amusing that this TEA group couldn't find a single victim to complete their silly complaint. This reminds me of the stupid lawsuit filed in the states because some girl wanted to join the Boy Scouts instead of the Girl Scouts.

I couldn't care less if someone wants to be gay but do the other 90% of us have to be bent over and have it shoved down our throats?

It's an ignorant, bigoted, unfairly discriminatory policy and the group fighting it is on right side of morality, and hopefully history.

Let's take your argument and apply it to racial or religious minorities to reveal how utterly hateful your POV is.

 

Of course your rude, crude,  intentionally provocate SEXUAL insinuations (bent over / shoved down our threats) is clearly related to a severe case of homophobia specifically.

But it's obviously not about caring about the sexual minority students. That's a lame excuse. 


To reveal that, do the race and religion substitution test as I did above. That would not be acceptable but somehow the bigotry against sexual minorities is to some people.

So, society as a whole should be forced to fork out extra money because of a few? You obviously keep a life sized poster of H. Clinton over your bed so you can sleep well.

 

If my use of "bent over and have it shoved down our throats" creates homophobic nightmares for you then how another old adage, "having it force fed to us"? When is it ok in your world for the majority of the people to make the rules?

There are tolerances and your reaching to compare it to "race" (which there is no such thing if you truly look at the word) and "religion" where, in this instance, most religions ban same sex relations of an intimate nature, you still make an ignorant argument. 

Those sexually deviant minorities have plenty of places to go get an education. 

By your way of thinking, the school should build a special dorm to house this minority, hire additional staff to care for this minority and pass the expense along to the MAJORITY that doesn't WANT their young, impressionable children overly exposed to what they clearly deem inappropriate behaviors which is why they pay extra money in the 1st place.

Be that as it may, it seems to have prompted you to change your avatar. ;)

You fight for those you do not know (or maybe you do?) but how would the situation suit you if it were your son or daughter being forced to shower, sleep and eat with people who find them sexually attractive? If the school forced both females and males to use the same bathroom and sleeping facilities you'd be up in arms. How is this any different?

Impressionable adolescents have a delicate enough psyche without being forced by an outside entity  to do things against the wishes of their families.

I'm defending the right of the school and the rights of the parents who chose that school for their beliefs to NOT have to kowtow to activists groups.

Newsflash: Not every school is a full time boarding school.

You did not answer any of my questions... which shows me you are not even thinking about the situation seriously... if at all. 

 

I would be happy for my children to mix with any other kids, gay, straight, various religions, colours, nationalities... what is important is people are good people, kind, considerate, tolerant, and treat each other with respect... so they grow up into good human beings. 

 

I would not want them to be anywhere near you for any length of time in fear of them becoming the kind of person you appear to be.
