  6. You can get usufruct for a limited time, but no longer than 30 years, or you can be granted usufruct for your life. It seems like you haven't read enough about the usufruct servitude. The law is HERE - you can go forward and backwards using the links at bottom of the page, the section 1387-1401 with "servitudes" is valid for all, including usufruct, and section 1403 sets the 30-years limit, re. section 1430 - but to express it the Thai way of thinking "up to you" if you don't believe what lawyers are saying, even they all say the same; nothing stops a land with a usufruct servitude to be both transferred or sold, apart from there might not be buyers as servitudes follow the land...????

Not all land offices accept a usufruct servitude given to a foreigner; don't forget that usufruct is an ancient Roman servitude to permit someone to harvest the fruits of a land, more correctly in legal terms expressed as using and enjoying the fruits or profits of something belonging to another. Furthermore, when already married a usufruct agreement can be declared void in case of divorce if the usufruct is granted by the wife; re. my earlier comments about have servitudes declared before transfer of title deed. Furthermore - and I'm sorry to mention it, it's general - a usufruct is given to a specific person only and cannot be transferred. A usufrcut runs for an agreed number of years up to a maximum of 30 years, or the usufruct runs for life of the beneficial. In my view it's important that one shall always be worth more alive than dead in Thailand. To my knowledge that is unfortunately not correct, land can be both sold and transferred, but the usufruct - and other similar servitudes like superficies and habitation rights, and also a lease agreement - is still valid. The value of the land might however be lower in case of a superfices or habitation servitude - the are no income from these rights - wherefore it's more difficulty to sell the land. ????
  10. An experienced real-estate law firm - preferably with a foreign solicitor - is always extremely advisable when "investing" in property in Thailand. The website Samui For Sale has detailed information about superfices, lease rules, explanation of title deeds, family laws and much more, which might help you a lot to look at. There are also other websites with lots of information, but this one seems to be one of the best. A lease agreement can be made so you can transfer the contract to third party and thereby sell the building you own including the remaining part of the lease period's 30 years. If you wish to be fully independant as house owner, you can establish a Thai company limited that owns the land and lease or rent out the land to you - the company should preferable have some additional activities and not just being a shell land owner for one of it's shareholders - where you are owner of the building(s). It a little more costly solution but might be a lot cheaper than loosing too much - or even everything - in a worst case divorce-scenario. If you pay for all you might even be able to have your shares classifies as "separate property", if your wife will accept and sign for that; or you can own 49% of the shares, and give your wife 48%, and a third party 3% preferred shares without voting rights, but with a guaranteed yearly dividend of for example 4% instead; in that way 49% ordinary shares can be in control of the company. If the property is sold to a foreigner the company limited-method can furthermore have benefits, as the property is not transferred to a new owner, only the shares of a company limited are traded...????

We have for about 10 years now a "Keep Samui Clean" garbage collector coming on motorbike with sidecar twice to three times a week to take our garbage bags and other used stuff, including clear bags with things for recyckling. Those motorbikes with sidecar drives into the small sois - and also into private roads like ours - the fee for the service is affordable 300-400 baht a month per household. OP - and others - could try to ask their local poo yai ban (Head of village) if such service is available in their area. Of course, if garbage collection is not paid for, garbage is not collected. Unfortunately some of the places people dump their garbage - I unfortunately see folks just throwing a bag there when passing in car - looks like a mess and are negatively commented by tourists, not the best image for Samui, which should be able to be done a lot better and more sufficient, but that's a personal point of view.
  12. You need a supercies servitude to build your house on someone else's land, and you might also need a 30-year lease or other agreement to use the land. You cannot make the agreements with a spouse, as in case of divorce agreements between married couples can be void, so get any servitudes registered before land is transferred to a spouse's name. Your proof of house ownership will be the building permission in your name (important document), for which you need a superficies og other written permission; furthermore architect drawings with you name as house owner, all agreements in your name with building constructor, your name on all bills and money transferred from your bank account, or if paid cash receipts issued with your name. When you build a new house only these documents are your proof og ownership, it will not be registered separated from the at the land office before it's sold to a third party. My real estate lawyer mentioned that you can declare a loan as servitude on the land, which will protect the land from being sold or transferred to another name without the loan being paid in full. However, that shall also be done before the land is transferred to and registered in a wife's name. Another used method is the company limited-way, where a company owns the land and lease it to you, while you own the building(s) on the land. This method both require som running costs - keeping the company going with accounting, auditor and annual reports - and finding Thai partners that in principle owns 51 percent of the company; preferred shares can keep a voting majority in your favor. I own my house, but not the land under the house. A benefit to own a house is that it's a home and void for paying the new property tax for an aparised value up to 10 million baht. The land under the house is however taxed, as that land it rented out. You need a document from tessa ban-office - which is the office issuing building permissions - for the revenue-office, to prove that you are the house owner, i.e. the name on the building permission. As house owner I'm also the one that approves who can be registered in the house book, but it's as house master, it's not a proof of ownership...???? Edit. If you build the house after marriage, it might be common property, if it's not build for separate property's funds, for example funds from inheritance. Check with a lawyer for details.

  14. Cruise ships and private yachts already come - I live by the sea on Samui and I see quite a few - and the lack of a proper marina might limit the number...???? I don't take many photos of cruise ships and yachts, but in between there are some more exciting one arriving, like this (well known) yacht for example that so far has anchored up twice in the bay where I live (it's Russian owned, so might not come back for a while)...

  21. An international drivers permit - and yes, some countries calls it a "drivers license", including my home country - is only a translation of your drivers license. If the domestic drivers license got latin characters and English text, it's accepted in many, if not most countries.

  24. Thai immigration will look at that your monthly foreign transfers are minimum 65,000 baht. However, if you has just a bit of savings, can combine a bank deposit with monthly transfers, which is accepted by most immigration offices.
