Grandfathering did not require any amount of previous extensions, all that mattered was your age and extension status on 21 October 1998 (both age and financials changed that day)

I did not say it couldn't , but the post I quoted quite clearly mentions a VOA, which is totally different to a visa exempt entry I mentioned it to clarify the point for other people reading the thread who may be in a similar situation

Actually it is MORE time without your passport, the consulate keeps your passport to issue the visa, immigration does not

You appear to have totally missed the point that the passport expires before his extension of stay, and the he does not have time to get a new passport (ergo the op needs to check when his extension actually ends)

Terminated does not mean cancelled. Plenty of horror stories of people not cancelling Ed and B extensions and then being charged overstay when they apply for a new extension
