As I linked above according to incoming Senate majority leader Thune, the concern is not whether recess appointments are constitutional but by what procedure the Senate might go into recess if a sufficient number of Republican senators oppose it. And the Supreme Court has already weighed into that as I'm sure you know. Presidents like Ronald Reagan, Clinton and both Bushes did use recess appointments, although usually for positions below the Cabinet level. Only three Cabinet secretaries have been appointed during a recess since 1900, according to the Senate Historical Office. This topic is about cabinet appointments that need (short of recess appointments) Senate confirmation and, for right now, the ones putting at least a verbal damper on that are Republicans. The GOP now has a slim Senate majority and these folks, down the road, will be essential to pass any legislation that Trump can't ram through with an executive order. -
