Constitutional judges ‘want to quit’ despite new law

Most of the five constitutional judge whose terms have expired want to quite even though they are allowed by the new organic bill to temporarily stay in office, Supoj Kaimook, a former Constitutional Court judge and writer of the bill, said on the weekend.

 

Supoj said he was close to the five judges and had learned that only a minority wanted to stay.

 

The development came after the National Legislative Assembly (NLA) on Thursday passed the organic bill governing the Constitutional Court, which contained a number of controversial clauses. 

 

Among them was an extension of the term of service for judges. 

 

The NLA vetting committee revised the bill to allow judges to remain in office until their successors are selected, which could take at least a year, regardless of their expired terms and qualifications.

 

Supoj, who vigorously opposed the clause during the deliberations on Thursday, said it violated the new Constitution.

 

“Unless it is revised, it could affect the court’s essence,” he said. 

 

“For instance, if a petition in regards to the issue is launched for the court to consider whether or not the clause is constitutional, then will it accept the case? How will it decide?” the former judge asked.

 

Such a scenario could be viewed as a conflict of interest, he said, while questioning why the NLA thought the five judges wanted to remain in their positions.

 

After the Constitution Drafting Commission receives the bill next week, it will discuss opposition to the bill and seek to establish a joint committee to review the law, Supoj said.

You think that there was fairness in the law before the junta?

But they said, it was going to be different, no corruption, better, so that's why there was a coup.

No, not at all, but the people who usurped power said they did so to stamp out corruption and make Thailand a better place.  All they have done is favor themselves, the elite and go after the Shinawatras.  There are no improvements.

While they havent done everything the way it should be they have certainly done more than other govts. There has been a fair bit of corruption singled out against many different people including police, they have done a lot about the land encroachment, they have pulled the fishermen into line etc. Simply saying they have made no improvements isnot correct and definitely biased, they are certainly not a great govt but they have done a lot but need to do a lot more before I would call them  a good govt. They have chased the shins but lets be honest they needed to be as they were getting away with too much, just a shame they havent chased others as hard

Really...? What have they done? Specifics mind, and don't bother with the corruption thing, for every case convicted, there are 2 close to the army which have not been proceeded with. To see properly, one must open one's eyes.

All those things you mentioned were either attempted by A44 or were the duty of navy anyway.  The Shins never had any control over the military and even A44 with land encroachment is now a favorite past time of the elites.  Virtually nothing has been gained with peace at any price with a government who can do what they want.  It has done nothing while previous governments worked within the law.  There were hundreds of land encroachment cases before the coup.  Trying each case takes time.  Today powerful people are still using delaying tactics to encroach.  The junta even with A44 has not been effective.
