That was probably because your extension was still valid. They will not cancel an extension without a valid reason. Divorce is a valid reason to cancel to the extension and then apply for one based upon working at the same time. You would not be applying for a non-b visa since that can only be done if you are on a tourist or visa exempt entry. No problem with the visa exempt entry other than having to go out again to get the non-b visa unless you can qualify to apply for it at immigration.
