Hi,

I have been in Thailand for 18 years and always on a work permit, Workpermit was always renewed every year and my original non-B extended repeatedly.

I am now out of work and need to extend somehow, current visa runs out at the end of this month.

I am not legally married but have a child with my name on the birth certificate.

Child has thai passport.

 

Is it possible to extend my non-B visa based on child ?

the information i find online talks only about extending non-O visas in this way.

 

Thanks for any advice.

As you are not married, you need to legitimise your child first. 

Being on the birth certificate is not enough. 

You are not renewing your visa, until now you have extension of stay based on employment. 

Now you want to have extension based on family. 

Only pre requirement is a non-immigrant visa.

You could apply for an extension based upon being the parent of a Thai. All you need is a non immigrant visa entry to apply.

But you must be the legal parent of your child by way of marriage or legitimization of your parenthood.

The legitimization can be done in a short period of time at an Amphoe if your child is 7 years old or older. If not it has be done through a court.

You will need 400k baht in a Thai bank in your name only or proof of 40k bath to apply for the extension.

OK, not good news.... my son is 4 1/2.

I will try at the Amphur office to see if they will accept his word, and drag along father in law as he used to be quite high in the military... maybe that will help.

otherwise if it has to go to court, and reading through the link attached above, this can take 1-3 months, can i get extension based on some other reason ?

 

I'm in Suphanburi.

You could get a 60 day extension to visit your son. 

He would have to be with you when you apply. You will need his birth certificate plus a copy and a copy of his house book registry.

OK, 60 day extension whilst awaiting court approved legitimisation...

However, just discussed with my GF, and she's against the legitimisation as she thinks ill then be able to run off with my son and go back to uk...

She wants to get married, i dont as then all her debts and bad credit will suddenly be mine also......

 

Putting to one side for a moment the relationship issues here(im sure im not the first, or last)... ill be 50 in march, is it possible to get the non-B extended because of retirement ? assuming the requisite 800k in the bank etc?

I think she is confusing legitimization with custody. She would still have to grant permission for you to take your child out of the country.

Yes you could change your current extension from working to retirement. You would need 800k baht in the bank for 3 months or proof of 65k baht income or a combination of the 2 totaling 800k baht.

You could get the 60 day extension to get more time to prepare for the retirement extension near the end of the 60 days.

If you don’t want to get married you should still get your self legalised as the child’s parent. That is in the best interest of your child, especially if you split up from the mother.

 

You can change to an extension based on retirement, but it will be better to do it based on being a parent. That way, if you go back to work, you can get a WP without changing the reason for your extension again. Plus you only need 400K in the bank on the day you apply for the extension (parent).

I just got back from the Amphur office after getting the legitimisation done., No problem about child only being 4 1/2 years old.

 

I was issued with a letter that they wrote up specially saying that i am living as husband to my partner but not registered as married legally and that she has confirmed the child is mine and that i share responsibility for the childs welfare.

Its officially stamped and signed but i get the feeling its not going to do the job, i was expecting some official form, or at least a template to be used......

 

ive not yet shown it to the immigration dept, when i spoke to them about this last week they seemed to know less about this than i did (due to advice from here).

 

Should the legitimisation just be a letter ? or should it be an official form ?

The affidavit you have been given by the Amphur is all you get. 

 

Being named on the birth certificate doesn’t confirm you are the father so immigration want this document as confirmation.
