What are my parental rights as a legitimate father

Featured Replies

I have gone through the court process of legitimizing myself as the father of my child with a thai mother.  I am a full-time resident in Thailand with work permit.  What are my parental rights?  Am I on the same footing now with the mother as far as custody, residence decisions, etc., or does the mother’s rights still supersede mine at this point?

If you have gone through court and the court has agreed then you have 50/50 custody rights, yes.

When I divorced I received 50/50 custody rights. When push came to shove it meant nothing compared to the Thai mothers rights and wishes .Confirmed by more than one lawyer.

Better having your child declared in your country of origin.

As a French citizen, I declared the birth of my son at the French embassy in Bangkok, within the mandated 30 days.

In return, he automatically received French citizenship, along with the Thai citizenship, and has got both passports.

As for myself, things are much easier when I take him to France.

Keep on good terms with the mother and any requests you make will be viewed (hopefully) favourably.....this is Thailand where the mothers wishes come foremost....you are an outsider even though you are legally the childs father and the court system is both costly/time consuming and biased towards the mother....

Good luck

better still don't have a child.

The devil is in the detail !
You may have declared yourself as the father , and given your child the right to inheritance in the event of your death .
You need to check the detail of your agreement to make sure that you have equal rights with the mother regarding everything, excluding residency.
If your agreement doesn’t state as much , then you should go back to court again with a better lawyer.
