When a person is ' on bail ' he/she are allocated an Immigration officer so that they stay within the Thai law regards overstay.I have seen first-hand immigration officers go to the court of first instance, where they go to the court clerks office with the defendant to see there is an ongoing case. Their passport is stamped and records updated after they get a paper from the court to state their case is ongoing and not yet concluded. This procedure is repeated when an extension stamp is due to expire until the conclusion of the court case, so in effect, they do not go into ' overstay ' Many times in the past, this information was not offered by Immigration and it was the defendant's job to find out and report themselves to Immigration or through a lawyer to ensure they stay within the law. After all, until you go there and tell them, Immigration doesn't know you have a pending court case, you could just be somebody on overstay! Regards Immigration Detention Centre in Bangkok, one of the worst places imaginable with people forgotten sometimes for years, especially when they have no funds to live off or for onward tickets to get back to their own countries. It should be inscribed on any young tourist's forehead that drug possession in Thailand (and other SE Asia countries) is ILLEGAL and if caught then there are harsh penalties including long-term imprisonment (and if found guilty of trafficking it could be the death penalty in other countries). stephenterry Posted April 29, 2018 Share Posted April 29, 2018 As far as Thailand police immigration and prosecution is concerned, and depending on where the person was arrested, they are capable of choosing/changing what route to take in regards of visa expiries, overstays or whatever, so I wouldn't take anything for granted except to have plenty of dosh to cater for any 'get out of jail free' contingencies. If they reported themselves to immigration within a reasonable timeframe, it would have had to be accepted. Argus Tuft Posted April 29, 2018 Share Posted April 29, 2018 Can confirm that there is a working system in place for those people caught up in legal proceedings in Thailand, whereby they are NOT charged for overstay simply because they did not have access to their passport and we're unable to leave at the time their original leave by date expired. She is not making any excuses for him, or looking for any sympathy. All she has tried to do from the start was to make others aware of the pitfalls of becoming involved with illegal substances in Thailand. No doubt she has been through 2 months of ‘hell’ and certainly does not deserve to be castigated for her son’s foolhardy actions.
