Tax-visa-rumours?

Featured Replies

ok

short but simpel

just came back from our family lawyer(thai)

she brought to my attention the changes for a marriage visa for all existing and futere marriage with a thai spouse.

having a income not less than 40000 bath (together or alone)

having paid tax (pit)

workpermit

ID wife

wifes house registration

m,arriage certificate

2 photos

1900 bath

NO mention of having 400000 bath in a thai bank

I assume its been replaced by 480000 bath(12*40000) because than they can claim tax.

so far i understand

altough one of my mates assured my that you need both....400000 AND 40000 income

treu or false

Then my lawyers comment of "new " rules involving retirementvisa.

she claims......

800000 non the bank is not efficient anymore

we need to have a income of no less than 65000 bath or NO retirementvisas this year when we apply for our new ones.(date of inforcement)

She claims.....

regardless of the amount of money you haver on the bank......in future(at renewel) you need to have income of at least 65000 bath

now i understand wy perhaps the immigration wants to lift the amount to 1.000.000 bath in future.

just because thats the highest tax (plus 30%) rate, you see on fortune they( the thai goverment )can not impose tax on income the CAN

It makes sence doesnt it??????

treu or false.

My dear friend(not the lawyer) even told me that in futere we need 800000 on deposit AND income for tax reasons

treu or false

who can shine some light in these matters?

thanks

Your lawyer is right on the annual extension based on marriage, but wrong on the extension based on retirement. Have her look at the Thai Police Order 606/2549, paragraph 7.21 regarding retirement. For you, an English translation is here.

The single biggest problem in communication is the illusion that it has taken place

His wife is a Lao. He can only go down the retirement path. 800,000 baht in a bank in Thailand, or an income of 65000 baht per month or a combination.

The "lawyer" is not fully right on either account. There is no option for bank account under marriage except for those already in the system. The rule is 40k per month family income and a work permit is not required unless the foreigner is earning the income in Thailand. If money is earned in Thailand you prove with tax payment receipts for previous three months. If money earned outside Thailand you provide with normal Embassy letter and supporting documents.

Retirement the only change is that if you use 800k bank deposit the money must have been in account for 3 months at time of application. There is no requirement to have both bank and 65k pension/income. There is no tax requirement.

These changes were made several months ago.

It might well be time the OP sourced a new lawyer. :o

Please take note of the highlights above. The Jomtien Immigration have added an extra word between these two statements. It now reads as and/or .

Granted this was on 18th Oct 2006
