Hello,

 

I'm hoping someone can help me here!

 

I arrived in Thailand on a Non-B issued from my home country and extended at immigration in Thailand when I got my work permit. I then had to leave Thailand suddenly due to family matters and was unable to cancel my extension of stay. My previous employer did cancel my work permit; however, immigration requires both the employer and the employee to be present in order to cancel the extension of stay. 

 

I am now going to return to Thailand and work for a different employer. The new employer has advised me to apply for a new Non-B in my home country and enter Thailand this way; however, I foresee this being a problem, as I haven't yet canceled my previous extension of stay. 

 

Does anyone have any experience with this? I'm concerned I will have to pay a large fine for overstay before applying for the new Non-B.  Would you recommend entering on a tourist visa, going to immigration to cancel my existing extension of stay (with documentation from my previous employer) and then applying for a new Non-B? If I do this, will I need to exit and re-enter once I apply for the new visa?

Applying for a new non-b visa and then entering the country will not be a problem unless you have a re-entry permit for your previous extension.

You will not have a problem due to your previous extension not being formally cancelled until you try to apply for a new extension at some immigration offices. Some offices will want you to have the extension cancelled at the office that issued it by showing a termination letter from your previous employer.

There is no fine for not formally canceling your extension.

This is good news - thanks! I don't have a re-entry permit attached to my previous extension. So it looks like the worst case scenario would be having to return to the immigration office that issued my original extension? 

 

My current extension is actually still valid and will be until June 2019.  I had to leave at the end of October of this year due to family matters, so I will be applying for a new non-B while my current extension is still valid (although not really valid because I exited without a re-entry permit).
