My apologies if this is answered but I can't find anything on it.

 

What (if any) is the process of obtaining a visa to live in Thailand, I am currently living in Hong Kong with my Thai wife, we have been married for the past 12 years and living together here with our 3 daughters (all Thai passport/ID card holders). We got Married in HK not Thailand

 

I am 45 years old so do not qualify for the retirement visa, I have sufficient funds in the bank for my retirement, so how do I obtain a visa that will allow me to reside in Thailand?

1 year multi entry non O VISA (for reason of marriage to Thai), $200

as many 90 day entries as you like in a year, with one more at the end stretching your stay to 15 months.

You would have to leave the country every 90 days.

But after the first year (or 90 days even) an extension of stay can be obtained whereby he doesn't have to leave the country anymore.

First you could apply a for a single entry non-o visa based upon marriage at the Thai consulate in Hongkong. Then you could apply for a one year extension of stay based upon marriage during the last 30 day of the 90 day entry at the designated immigration office for where are living. You will need 400k baht in a Thai bank for 2 months on the date you apply or proof of 40k baht income.

Prior to applying for the extension you will need to register your foreign marriage at a Amphoe. To do that your marriage certificate will have to be legalized. I suggest you get your marriage certificate legalized in Hong Kong before traveling here. Then after arriving here have your marriage certificate translated to Thai and have the translation certified by Department of Consular Affairs in Bangkok.

But why pay for a multiple entry non-o visa when he could apply for a single entry non-o visa and then apply for the one year extension.

If he got a multiple entry non-o visa he would not have to wait a year for the visa to expire. He could apply for a one year extension during the last 30 days of any of the 90 day entries from the visa.

Yes, I also see no reason for ME visa. Just get single entry and get an extension.

it is NOT illegal to marry a thailady in Thailand, do not understand what you are talking about. you are suggesting EXACTLY the very same thing as I do.....

But they have already gotten married somewhere. That is what I meant by illegal.

I am assuming the got married in Hong Kong and suggested they register their foreign marriage which is not the same as registering a new marriage.

i actually meant the very same thing of course. "get married" in laymen  terms are register the marriage elsewhere..

I also don't understand why you call that an illegal activity, Ubonjoe. I am married twice with my wife, in two different countries, and with the first one registered in my home country and in Thailand as well. I agree that registering his already valid HKG marriage in Thailand is entirely possible, but the other option of having a nice traditional marriage in Thailand could be interesting for them.

It is considered technically illegal to get married more than once.

Paperwork wise and cost it is best to register the foreign marriage here than registering a new marriage.

They could have the wedding ceremony here without registering a new marriage at an Amphoe it they wanted to.

A traditional marriage is, without amphur registration, not a legally valid marriage.

Clearly you gave this about 3 seconds of thought before your knee jerk reply.  (Giving you the benefit of the doubt that you gave it any thought at all) This guy has been legally married for over a decade to a Thai National and is fully qualified to get a Visa by way of marriage.  You need to be legally married to a Thai and be able to prove you actually share a married life together ... you do not need to tie the knot while literally standing on Thai soil.
