Landlord says I file the TM30 not him. He is too busy for that.

I just got into a heated argument with the agent who rented the condo to me. She says owner will just provide the documents and I have to do it myself. I told her this is something the owner is suppose to do, not me. I told her I will not do it and I will just tell that to immigration and the owner will have to pay a fine. <deleted> is this they just throw me all this work for something they have the obligation to do. Just want to collect the rent money from the foreigner and be sabai sabai.

I am not doing his work. I am tired of taking s^%T from them and be just cool about it.

Yours is a cautionary tale that this sort of thing should be sorted out BEFORE entering into a contract. Maybe negotiating a reduced rent in return for taking on this obligation?

 

You'll be fine until you have some business with Immigration, at which time your "coolness" may be tested.

The law also states the pocessorof the residence can do it as well as the landlord. Please read the law.

The first check before paying any deposit is will the landlord do the TM30, if not find a new landlord

I agree about that. Personally, if I'm the one who's facing a fine and hassle and delays at Immigration in the event of non-compliance, I'd rather "I" be responsible for doing it. That way, I know it gets done and I have the Immigration receipt coming back directly to me.

 

Instead of leaving it to the landlord, not knowing what or when they're doing, and then going to Immigration only to find out they forgot or had some other problem that's then going to complicate things for me.

So they assure you they're going to take care of it, and then you move it, and they don't do it every time you come and go, and then what?  Guess who's going to be on the hook at Immigration in the event the ball gets dropped?

 

Either the landlord or the possessor has to do it.

If you are renting a condo in your name, you are the possessor.

So you and your landlord have the same obligation by law, one of you has to do it.

FYI
I am not the owner of the house where I live, i downloaded the app "section 38" and I registered my self as a "tenant" (under position field I chose "etc." and right after appeared a new field where I wrote "tenant").
I attached a copy of the tabian Baan, a copy of my passport (details page) and the power of attorney.
I received immediately the email for the email address confirmation. The next day the email with user and password.
Now I can register my self and any relative or friend will come to visit..

True now but two years ago it was not something I would have been aware of and something a landlord didn’t have to be concerned about. It is a discussion I would have with any new landlord now.

How does a landlord know iif you will come and go and at what dates?

You must to contact them each time?

 

If it like that it will not be long before they get sick of it, they are quite well known to have a very short fuses.

 

Just maybe better to pay 800 fine once and wouldnt be rocking the boat on it to much.. .

Its could be a big worry for all of us in the future for many reasons,

but worst:

1. They decide they can easily rent to Thais because foriegners are to much trouble.

2. They start jacking up the rent because foriegner comes with all the extra hassles.

Take the responsibility yourself. You know when you're coming and going.

 

Get signed copies of your landlord's tabien ban page and Thai ID once upfront and keep plenty of photocopies of them, and then armed with that info and your own docs, you can either file the TM30 by mail and/or file it online.

 

And then you don't have to worry about missing a TM30 or the landlord or potential Immigration fines/hassles any more.

your going to be responsible for the fine no matter what the law says. thais are not obligated to rent condos and apartments to foreigners. in the future i predict no foreigners on tourist visas will be allowed to rent and there will be designated hotels were tourists are allowed to stay and that is it. 

If you're not going to need any type of Extension then don't worry about it.  But if you do need to go to Immigration for an Extension, you'll be f*cked if they insist on the TM30 being on file before you can do it.

There have been many TM30 threads here lately. In various of them, several of the TVF mods/admins have advised that the EN term being used as "possessor" in this context is considered under Thai law to include the notion of tenants.

No you may not ask for another link or anything else. I recommend that you search the forum. You will find lots of proof, by links and copies of official texts.

You say at the beginning that if you are charged it comes out of the rent.

 

my landlord only needs to do it on the entry before my extension but i usually get her to do it when i first arrive plus my final border run. Works for us

Here the official definiton:

oh, really? Is it that bad?

Sounds like we got the same landlord, I told mine it will be the last time I do it myself, else I move out.
