Hi all,

 

I was wondering if anyone could help or give me details for somehow who could potentially help?

 

I left my job in 2018. At the time my extension, which coincided with my WP was expiring around 3 months after I left. Unfortunately, I didn't cancel my WP/extension as I had to leave to get back to my home country at short notice and my employer wasn't reasonable to past employees with such requests. 

 

2 years later and my home life is now stable and have been offered a new job in Thailand. I was open and honest to them about what happened with my previous employment and that I stupidly didn't cancel my WP/extension. I am unaware if my employer cancelled my WP/extension. I know I wouldn't have had any overstay as I left with my WP/extension still intact. 

 

Will I have issues obtaining a new WP and when I come to do an extension, will I have issues there? I doubt I would be able to get a termination letter from ex employer and the other issue is that my passport got renewed and therefore I don't have the passport that my extension was given in?

 

Any advice is greatly appreciated

The issues will be with you trying to extend your new visa whatever it may be. I’m sure the WP will have been cancelled though. Make sure you enter on an entirely new passport with no reference to the old one inside. That way when your extension is considered, your passport will have no evidence of the non cancelled visa.

It will be difficult to say if you are getting problems when applying for a new WP.

It will be in the records that you left without cancelling the WP and extension correctly.

This is not something they like very much and can cause issues when applying for a new WP.

But if you have a good explanation and they have a good day it should not be impossible to get the new WP.

From what you're writing your WP and thus your extension of stay expired 3 months after you left in any case. So there is nothing to cancel at this point.

 

Some employers have the habit of putting employees who just leave without giving the mandatory 30 day notice on a blacklist which is shared among HR managers in the larger BKK companies. But that doesn't seem to be the case here since you were already offered a new employment, just something to consider for the future.

This will NOT help someone because the immigration software will show every visit to the country from persons with the same name, birthday, ... with photo.

I guess it’s not worth taking the job, which is disappointing. I don’t want to uproot my life to Thailand for immigration/labour to not allow me a WP/extension, which would result in be going back home

In the past i have twice just left some considerable time after my contract finished but within the duration of the extension,however you do need to leave from an airport for a hassle free no questions asked exit , each time i didnt cancel my work permit.

 

On both occasions i returned to employment with a work permit and a new b visa extended without hassle from the same immigration and labour office as my earlier employment.

I left the country the night my work permit and extension expired (31/12/2017).

 

I never expected to return and my ex-employer was happy to let the extension expire rather than following the law and cancelling it (I finished work 20th October 2017)...

 

Came back June last year to a new job.... lots of paperwork involving my ex-employer was needed before they would issue me a new work permit and extension.

I was fined 1500 baht at din daeng police station for not cancelling my WP. I stayed a year on the visa, nothing was said as the DoL don't tell the Immigration, or they never used to.
