Please correct me if i am wrong but i'm sure the prime minister is not necessary the leader of the winning party after an election, but is voted by the senate.

Correct I think.  But it was the new (most recent) constitution that allowed the appointment of the 250 and they will do what they are told by whoever manipulates them.
