I think they shouldn't let the embassy decide but based on which countries have flights allowed back. If they have flights allowed back home and they are not in poor medical health, there's no reason to allow them to stay on tourist visa. However you have no need of amnesty while your permission to stay (not visa expiration date - date shown on your last entry stamp, which can be later than the visa expiration date) is still valid. And you can do a one year extension of stay provided you meet the financial requirements. The time to apply for that will be 1-30 days before your permission to stay ends. Read up on the financial requirements (differs depending on whether you have a Thai spouse).
