advice about building a house in Khon Kaen

My Thai gf and I are thinking about building a house on her fathers land adjacent to his house but before I mention all the other things that need to be considered when taking on a venture like this I want to know will I be able to own the house or would it be under her name?

  • Perhaps off topic, but I would not build a house anywhere near the in-laws. I have been here a long time and know farangs that did and regret it.....???? But, I am sure there are exceptions...????

You will never own it, it will belong to whoever owns the land. There are certain steps you can take to protect yourself such as a Userfruct or other legal agreement for you to reside there. 

 

The Golden rule is dont invest any more than you are prepared to walk away from.

 

My recommendation is RENT for 2yrs then decide whats next.

Essentially, foreigners cannot own any landed property in Thailand. Other than condos, which you sign contracts with development companies as investors. Then there's maintenance fees, taxes, etc., which make those not so attractive.

 

As for property on land, there's a way to do it with enough money and a good lawyer to set up a "usufruct". You'd be leasing the land for a set period of time. I'm married to a Thai and have been in Thailand awhile, and have considered it. I've decided it's not worth the bother.

 

I won't elaborate, but this govt and its immigration have done plenty of things I've seen over the years to warrant not seriously investing in this country. Do contribute what you feel you should, to your GF and her family. Renovate or build them a new house. However, see it as a donation. Keep in mind that at any time, you'll have to walk away from it, without any rights or ownership.

What value or use is a house on her land next to her Father if you split?...

don't bother. rent and be free from worry and loss.

Bear in mind however that not all land in Thailand can be subjected to a usufruct. This will depend on the kind of Title Deed the land is classified.

Have you ever built a house before? This is a whole new ball game building in Thailand, you dont speak the lingo?

Rule No1 Dont employ her brother or any other family member it will be never ending, 

Take your time find a builder who can speak English and take a look at houses he has built and obviously get references,

You must have heard the saying, If you think employing a professional is expensive? wait until you employ an armature

A usuffruct would also be complicated because there is an existing house on the land, so the usufruct in theory would allow access to the existing structure

Simple advise. Don't do it. rent a home. never build a home in thailand. the moment relationship with the thai partner goes downhill, you loose everything. you would be lucky if she lets u leave with your clothes else thai woman would sell her ex's clothes on the street.

 

i know i am being bitter but i dont want to see another man loosing his money in thailand. building a house there is same as throwing that money in a river.

 

Anytime u could be kicked out and you wont be able to do anything.

Absolutely......100%......you have to be mental to consider buying/building unless you have money to burn.......buy in your own country where you know the laws and the market....use the rent from that to rent in Thailand.....it's a no brainer.

 

Buy and you are trapped....noise, bad neighbors, falling prices, exchange rates.........

Not sure where you are getting this information from, a Condo has a full property title just like a house/land, its not purchased as an investor with a development company. Buy a condo means your name on the title deeds. There are no extra taxes for Condos.

What is the gaurantee that buying a condo would entitle him hassle free entry. There are many reports that that condo owners have been denied entry. So why buy a condo when you know some I/O would deny you entry. 

 

on the other hand building a house for a thai wife means u r actually building it for her and burning your own money. The moment they want, u will be kicked out and u wont be able to do anything about it.

The quota for a farang wanting to buy a condo is 49% Foreign Freehold

There was a post on here the other week were a Farang cant even get his belongings out of the house, If it Fly's Floats or <deleted> then rent it

Thats not the original topic or statement. You said buying a condo involves being an investor in a development company. I was correcting you as thats not true.

Nobody has mentioned immigration requirements for entry into Thailand. Buying a property anywhere in the world doesn't guarantee immigration compliance.

Yes thats correct, but nothing to do with being an investor in a development company as the incorrect post said.

Thanks for telling me this. But atleast the I/O's in other parts would give u a fair chance. They would arrange a translator too in case of language barrier. But in thailand- u come too mutt,, why u come back, why u come again, no no, what u working in thailand,, go back ..

I dont want to sound negative the more I think about this the more it sounds a bad idea, if the father owns the land and there is a house registered on the land is there one Chanote for the whole land or two separate chanote's? or maybe no chanote maybe farm land they could be telling you anything as you cannot read Thai and at the end of the day all you are doing is improving the value of someone elses property and land which they can take back anytime they want.

There is only one style allowed.

 

It shows you: when they want you out, you get "kicked" out ????
