I have an 18 year old daughter who gets an O visa as my dependent; I work as a teacher here in Thailand. I understand I can get the O visa for my daughter each year until she reaches the age of majority which is 20 here in Thailand. I am due to extend my visa for one more year and I was told by my school that the provincial authority is requiring that children on an O visa include in their application a letter from their school and a school photo as well. My daughter just finished a certificated program and is currently not enrolled in a school. 

 

I would like to know if the Provinical authority can indeed reject a visa application for a minor if they are not enrolled in school at the time of the annual visa extension? I am not sure if this school letter requriement is a Visa regulation or if a bureaucrat simply wants to take precautions in case they get called out by a superior at some point in the future.

 

As I understand from my school, when a foreigner extends their visa  the process is:

1)  an approved application for extension by the Province you live in

2) a clean tax record proving you owe no tax

3)the application and issuance of a work permit.

 

When these steps are complete, you can then apply for a visa exentsion at Thai immigration. I ask for confirmation about the process because often the school does much of this preparation for their foreign teachers.

There is no requirement to prove your child is attending school for them to apply for a extension for being a member of your family.

The extension is applied for at the designated immigration office for where you are living. You do not need anything from the province where you living to do the application.

Your child only needs the O visa to enter Thailand. Once in Thailand they can get an Extension as your dependent every year.  As UJ says, it's irrelevant if they attend school or not; they are just 'piggy-backing' on your Extension of Stay for work.  

 

I do wonder at what age a child can continue being dependent, and when they would start needing their own Extension.  I would be surprised if it continues long past 18.

Visa extension approvals are the responsibility of Immigration not the Provincial authorities. Until she is 20 she can piggy-back off your extension as a dependent.

Thank you for these answers.  My school has told me each year they have to submit paperwork to a provincial office as part of the visa process. I work at a private school so perhaps it is a requirement for private schools. I will check into this in more depth. Thanks again.

That would be the provincial office of the Education Ministry to get the approval from them. 

They certainly would have no say in your daughters extension of stay.
