CNN  — 

A Brooklyn-based federal judge was selected on Thursday to serve as an independent arbiter to review the materials seized in the FBI’s search of former President Donald Trump’s Florida home.

The special master will be Senior Judge Raymond Dearie, who was put forward as a possible candidate for the special master role by Trump, who had sued in court to obtain the review. The Justice Department also endorsed Dearie’s appointment.

US District Judge Aileen Cannon also rejected the Justice Department’s bid to revive its criminal investigation into classified documents seized at Mar-a-Lago last month.

Justice is being served, Trump’s pulling every stunt he can think of to try and slow it down but Justice is coming.

 

Trump can have his KFC menus back, the classified and secret documents he stole will remain with the DOJ as evidence, after which they’ll be returned to the National Archives.

 

Trump can answer for the whereabouts of the classified and secret documents he stole that are no longer in his possession.

That judgement is being appealed. Most legal commentators I have read ranging from left to right think her decision is based on extremely flawed interpretations of law.

the only thing flawed is garland and his questionable legal strategy now after he fumbled around thinking he could walk all over Judge Cannon. She's got his, the DoJ & FBI's number now. There will be no more illegal DOJ leaks re MAL raid, nothing in essence will happen with the seized docs & records as ruled by her. Garland has messed up, showing just what am amateur deep state political operative buffoon he is. Trump walks/wins AGAIN, no indictmen. Your opinion seems fueled more by bile than by understanding the situation.  Judge Cannon won't be passing judgement on these documents. This is in the hands of the Special Master now. A special master that the Justice Dept. approved of. If Cannon's decision isn't overruled, he'll get to decide. Not Judge Cannon. You think that all or most of those documents will be judged to be legally held by Trump? That seems very unlikely. The law signed by Trump is very clear about that. What Trump's team has done is to delay the almost certainly inevitable.

Remember, it is not the Special Master's job to assess the merits of what the DOJ is doing.

 

His only job is to make sure the things the DOJ is NOT entitled to see and use.......... (privileged communications, private and personal things)............ get separated out from the many things they ARE entitled to see and use.

 

This process could be fairly quick, since the DOJ claims they've been doing these things themselves, already.

 

The Special Master should accept at face-value anything the DOJ has already done, rather than wasting time combing through it again.

 

If the DOJ is already saying they have no interest in those things they've already separated out........... there's no reason for the Special Master not to accept that!

 

After all, why comb through a bunch of things you know the DOJ isn't going to contest, anyway, since they separated it out, themselves?

 

If the DOJ has been as thorough about this as they would like us to believe............ (Remember, their argument before the judge was that a Special Master wasn't needed......... because they were already doing it themselves, anyway!).......... then there really shouldn't be all that much left for the Special Master to do, anyway!

Actually, your interpretation of what garland did is exactly wrong. He gave the Judge a chance to redeem herself. She must have seen the huge amount of criticism she got from some very right wing legal scholars. And exactly how will Garland be gone after the midterms? Even if the Republicans gain a majority in both the House and Senate, and decide to pursue impeachment, it's dubious that they would have the votes to succeed. And even if they did succeed, why would that stop the investigation. Your bile seems to have overexcited your imagination.

It's a stalling tactic. Trump was lucky to get a Trumpist stooge "judge" so the stalling will happen. The only question is for how long and to what effect. Remember that any decisions that either side doesn't like will face continuing legal battles, item by item. Justice delayed is justice denied. This was an almost perfect case until Trump got that lacky judge that thinks ex presidents are above the law. It may be back to other avenues, such as the Georgia case, which is still a very big threat to the losing president.

Prosecuting actually very very serious FELONY crimes that are a threat to national security is not persecution. The Trumpist line is that this one ex president is above the law. I don't think this is what the founders had in mind!

What you are referring to is old news. Namely that the acting head of NARA asked Biden if she could waive executive privilege for Trump. He gave her permission. It has nothing to do with revealing any new information from the warrant. And that's what you claimed.

The first sentence from your source provides useful perspective:

 

"The Biden White House, at the request of the Justice Department, signed off to have the FBI and the intelligence community examine hundreds of pages of classified documents former President Trump turned over to the National Archives and Records Administration (NARA), a newly-surfaced government letter reveals. "  

 

There is a big difference between the President initiating an investigation of a former President, and the President approving a request from the Justice Department to examine classified that the former President possessed and refused to return to the government.  Also from your source:

 

"Administration officials privately defend the document review process, saying the Justice Department, by law, cannot make unilateral decisions about executive privilege, and that, ultimately, the sitting president decides. Those officials said Biden’s decision to defer to NARA and the DOJ was fully consistent with his executive authority."
