WASHINGTON − Republican megadonor Harlan Crow paid private boarding school tuition for the grandnephew of Supreme Court Justice Clarence Thomas, according to report Thursday in ProPublica that was likely to bring a fresh round of scrutiny to both Thomas and the ethics practices at the nation's highest court.

Thomas had taken legal custody of his grandnephew at the time and told C-SPAN in an interview he was "raising him as a son." Tuition at the Georgia boarding school ran more than $6,000 a month, ProPublica reported. Thomas did not note the payments from Crow on his annual financial disclosures.

Supreme Court justice Clarence Thomas voted to end federal tenant protections that his billionaire benefactor’s company says threatened its real estate profit margins, according to corporate documents reviewed by the Lever. Thomas did not disclose his relationship with real estate billionaire Harlan Crow, nor did he recuse himself from the 2021 case, despite its potential impact on Crow Holdings.

Now, rent control — which Crow Holdings’ documents also say threatens the company’s business — could come before Thomas, and there is no indication he would recuse himself if it does.

Justice Thomas will probably write that the government should not be involved in student debt relief, and that tuition should be left to "contributions" from Republican mega donors.

Judicial activist directed fees to Clarence Thomas’s wife, urged ‘no mention of Ginni’

 

Conservative judicial activist Leonard Leo arranged for the wife of Supreme Court Justice Clarence Thomas to be paid tens of thousands of dollars for consulting work just over a decade ago, specifying that her name be left off billing paperwork, according to documents reviewed by The Washington Post.

 

In January 2012, Leo instructed the GOP pollster Kellyanne Conway to bill a nonprofit group he advises and use that money to pay Virginia “Ginni” Thomas, the documents show. The same year, the nonprofit, the Judicial Education Project, filed a brief to the Supreme Court in a landmark voting rights case.

 

Leo, a key figure in a network of nonprofits that has worked to support the nominations of conservative judges, told Conway that he wanted her to “give” Ginni Thomas “another $25K,” the documents show. He emphasized that the paperwork should have “No mention of Ginni, of course.”

Senate Judiciary Committee Chair Dick Durbin issued a statement last month calling for “the full extent of Mr. Crow’s and the corporations’ gifts to Justice Thomas, what other individuals were able to gain special access to Justice Thomas and any other Justices via the travel and lodging provided, and whether those individuals had interests before the Supreme Court.”

 

Crow claims the request to review the gifts is unconstitutional and has declined to comply.

 

“Given the sobering separation of powers concerns at stake, Crow’s contempt of the U.S. Congress is truly contemptible.”
