US special counsel Jack Smith asks judge to place gag order on Donald Trump

The prosecutor leading the federal election meddling case against Donald Trump has asked a judge to place him under a gag order, limiting how he is able to publicly comment on the case.

Special Counsel Jack Smith's filing says the "narrowly tailored" order would prevent harassment of witnesses.

Mr Trump hit back online, accusing Smith's team of misconduct, writing: "they won't allow me to SPEAK?"

He has pleaded not guilty to conspiracy to overturn the 2020 election.

The request was unsealed by District Court Judge Tanya Chutkan and was filed a week earlier. It was among a slew of older court documents from the case that were released on Friday.

Prosecutors say their proposed order - which they never refer to as a "gag order" - is "a narrow, well defined restriction" that is necessary to prevent disinformation, threats and "prejudicing" the case.

 

If approved, it would ban Mr Trump from making statements "regarding the identity, testimony, or credibility of prospective witnesses" and "statements about any party, witness, attorney, court personnel, or potential jurors that are disparaging and inflammatory, or intimidating".

It does not place any restrictions on Mr Trump from quoting from public record court documents or proclaiming his innocence.

Any restriction placed on the former president's first amendment right to freedom of speech, particularly as he runs for president in 2024, would kick off a major constitutional challenge in court.

Last week, lawyers for Mr Trump wrote to Judge Chutkan, calling her biased against Mr Trump and asking her to step aside from the case.

It is unclear when she may issue a ruling on either motion.

On Truth Social, Mr Trump's social media platform, he wrote on Friday: "So, I'm campaigning for President against an incompetent person who has WEAPONIZED the DOJ & FBI to go after his Political Opponent, & I am not allowed to COMMENT?

 

"They Leak, Lie, & Sue, & they won't allow me to SPEAK?"

By putting threats to the judge and prosecutors at the heart of its argument to limit the former president’s statements about the election case, the Justice Department raised issues that have little precedent.

 

There is little precedent for how the judge overseeing the case, Tanya S. Chutkan, should think about how to weigh strong constitutional protections for political speech against ensuring the functioning of the judicial process and the safety of the people participating in it.

 

“Everything about these cases is making new law because there are so many gaps in the law,” said Paul F. Rothstein, a Georgetown University law professor and a criminal procedure specialist. “The system is held together by people doing the right thing according to tradition, and Trump doesn’t — he jumps into every gap.”

 

“It’s a really hard argument in normal circumstances to say the government, who is prosecuting someone, can shut them up from defending themselves in public,” Professor Tarkington said. “What makes this backward from everything else is that normally, in every criminal prosecution I can think of, the power imbalance is that the state has all the power and the defendant has none. But in this case, you have a defendant who has very significant power.”

No matter how much they hate him, they have to bear in mind the millions of his supporters, and the consequences of going too far.

Oh I wish they would and if anyone is dumb enough to do something that’s great gets them out in the open and possibly off to jail with trump that would be great!!as far as the trust fund baby being protected in prison I imagine it would be standing behind some when he runs his yap just like he always had since infancy that’s how he’s got away with mouthing off all these years

If it increases his support and contributions, more fool the idiots who are doing their dough. We can't have a legal system where it';s permitted the threaten judges and jurors.

If you can't outperform the S&P in business you are a very bad businessman and hopeless at deal making.

US controller groups have been able to hold Julian Assange captive and he's not even on US soil. I'm sure they can sort Trump out.

NYAG is seeking a $250million settlement against Trump.

 

I believe he’s upside down and won’t be able to make that payment without triggering a run on his properties and the loans that own them.

Maybe he can get a loan or 'investment' from the Saudis and MbS. Hey -- it worked for Jared K.
