Small update 3 weeks after the event.

Seen the hitters police report, he admits to following me and running me down because my bag knocked his car.

As for me,

Most of the cuts and scabs have now fallen off.

Lots of muscle damage, blue right foot, blue right shoulder hip and elbow, knee painful, hip doesn't work properly so hard to walk.

I can just about get around the inside of the house by myself, up and down stairs.

Feeling a lot more hopeful of a full recovery now, even if it is still 1 or 2 months away.

I hope the 200 K baht also does make it your way - better than nothing...  though more importantly I hope your injuries are fully recovered.

That's why sentencing is in May, no money paid gets him 2x jail time.

 

Not actually a win for me as it was the public prosecutor Vs him (not me Vs him), I was just a witness to his crime).

I'm a little confused, what is the 1x jail time ???... Or is that the expected sentence you've been informed might happen and that would double if he doesn't pay your compensation ?

 

Given that he's attended court, admitted fault etc...  I expected that he'd just get some nominal suspended 6 month sentence etc....   so actual Jail time would be very surprising.

Judge said 5-10 years (which I thought was a bit harsh).

And with a criminal record, he'll never work for the government again.

(Pure speculation on my part, as I didn't understand most of what was going on).

WOW - thats quite extreme....   Yes, he tried to run you don't in a fit of rage, but usually the Thai courts are extremely 'forgiving' to someone who's admitting guilt.

 

I'm shocked that 5-10 years or anything close has been mentioned, particularly given his position.

 

Anyway - good result...   even though given the injuries its clear that anyone would wish the 'event' never occurred in the first place.

Last month I was invited to the probation office to discuss his sentencing.

A bit odd I thought, but I'll go.

They asked if the 200kbht compensation payment was enough, or did I want more and I told them ......

He's a danger to the public, if I say I'm happy with the money and you let him go .....then he harms someone else = my fault. So I'm saying he shouldn't be allowed to walk free, and if you let him go ..... then he harms someone else = your fault.

Which I could see they didn't like (they clearly wanted to let him go), but they wrote my comments down and passed them on to the judge.

 

So this morning was sentencing,

Judge shouted at him a lot then said he couldn't be trusted to mix with the general public.

3 years home incarceration at his parents house with ankle monitor, monthly psych evaluations to evaluate his ongoing danger to others, plus community work and 15kbht court fees.

(This was all in Thai, but I think I've got most of that right, a lot of words I had to guess)

 

An armed policeman led him from the court to fit his ankle monitor.

Surprised they actually listened to me, he won't be running anyone down for the next 3 years.

And my injuries had essentially confined me to my home for 4-6 months, so in keeping with the crime.

 

My misses comment to me outside after ...... "I'd rather have had a year in jail and got it over".

19 months from crime to sentence.

Right at the start his lawyer asked how much to drop, and I answered 1Mbht, they didn't reply and never spoke directly to me again. He obviously thought saving 800kbht but losing his government job, never working again, and staying in his parents house for the next 3 years was a good deal!

 

They probably could have haggled me down right at the start, but once it's public prosecutor Vs criminal ....... you're out of luck.

 

My misses only filled in a police report so I could claim on my m/c government minimum insurance for hospital costs, nothing more (13,800bht). The the police found the guy from traffic cameras (who could have imagined that?), I didn't hire any lawyer, I didn't press any charges, I didn't expect anything, I didn't spend any of my money (except 2kbht for an interpreter to fill out police forms). But they kept calling me back to sign another form, I didn't really participate except as a witness to a crime.

A good result. A pity you got no monetary compensation; however, removing him from being a danger to the public is probably just as satisfying.
