The SCOTUS ruled 6-3 along ideological lines in Trump v. United States that presidents are immune from criminal prosecution for “official acts” but may still be prosecuted for unofficial acts.

 

  1. A President has absolute immunity when he exercises his core constitutional powers: “Congress may not criminalize the President’s conduct in carrying out the re­sponsibilities of the Executive Branch under the Constitu­tion.”
  2. A President has presumptive immunity from criminal prosecution for his acts within the outer perimeter of his official responsibility. This covers actions “so long as they are not manifestly or palpably beyond his authority.”
  3. A President has no immunity for his unofficial acts

1. This applies to all Presidents
2. There are core and peripheral official acts. There is absolute and presumptive immunity
3. All presidents have absolute immunity from prosecution for core constitutional official acts
4. All presidents have some presumptive immunity for peripheral official acts
5. No president has immunity for anything done in an unofficial capacity
6. All of the above is well laid out in precedents (for these you do have to read the rest of the opinion-hint: mostly Youngstown and Fitzgerald but with a little good old Marbury from your Freshman year in high school)
7. Both parties in the specific case and the judges who have looked at the case so far agree with most of the above
8. As to the specific case, none of the parties or the judges who have looked at the case so far have addressed these issues “at the current stage of the proceedings.”

That binder could put Obama, Clinton, Biden and many others in prison for a long time.

Trump holds all the card now, Biden's pathetic attempts to stop Trump have failed, and will hand him a humiliating beatdown Nov 5 at the "battle-box" huh Joe, or as those with a functioning brain refer to as the ballot box. LOL.
