The notion of pardoning a "phantom" crime would almost certainly end up at the Supreme Court. Before that happens, Hunter would need to be charged with a felony that occurred with the pardon period. SCOTUS wouldn't take it on until 2026 at the earliest, we'd maybe see a verdict in June that year, otherwise 2027. 

 

Jack Smith is already being investigated for misconduct by the DOJ, it will be interesting to see if he is given a "phantom" pardon. 

Makes the case that some Biden pardon nominees may refuse to accept a "blanket" pardon, and probably should.

Just because his opinion agrees with yours doesn't mean he's telling it how it is.  He's telling it how he sees it.  More accurately, how it best optimizes his numbers, given a lefty audience and lefty advertisers.

The original article characterizes the proposed move as "unprecedented" for good reason.  It would be stupid and could eventually be ruled unconstitutional, I believe, given the circumstances.  Of course, there's some precedent and the courts have ruled that such power is basically unlimited. Still, the courts are political these days, so who knows? 

 

Perhaps Biden has some advisors that will set him straight.  The political fallout could be enormous.

Correct - these are untested legal waters and its an extraordinary move by Biden. In my opinion the Supreme Court would love to clarify this part of the Constitution. 

 

Tom Fitton, of Judicial Watch, has already said that pre-emptive pardons won't work. You can guarantee he will be all over this issue like a rash.

Picture the situation. Adam Schiff, who led the impeachment against Trump, receives a blanket pardon dated to Jan 1 2016. 

 

By law, he then cannot use the 5th Amendment in front of Congressional inquiries or Grand Juries. He could refuse to testify to Congress. The last guy that did that was Steve Bannon, and how the Democrats celebrated when he was jailed for contempt.

Patel stated in his book and in interviews he would prosecute people who failed to believe the stolen election lie. Failing to believe a lie is not a crime, but Patel has stated he will go after former govt officials and media personalities.

 

Kind of smells lie Fascism. But the cult is okay with that, though they cried like babies when their messiah was indicted for stealing hundreds of classified documents, which IS a crime, or getting intimately involved in the fake elector scheme..

John Durham gave, inter alia, John Brennan a clean bill of health for the manner he handled the intel received from liaison and other sources related to 45's campaign cooperation with Russian intel assets, such as Konstantin Kilimnik.* (I know John set up a Bigot List as soon as the intel came in, hand carried it to the WH for Obama to read, and sent all of it to the FBI, the agency with the authority to investigate Americans. That is textbook handling of intel of that sort. Durham not only interviewed everyone on that Bigot List, he even interviewed agency personnel who had no knowledge of the intel. The agency came out 100% clean. Maybe Patel is unhappy about that and will now investigate Durham.
