First seek a consultation with a local Thai lawyer familiuar with the family court.  Divorce litigation can be slow but not too expensive.

Really, not too expensive? An acquaintance in my village told me after his divorce that lawyers are expensive. I'm going to see on next week. I guess I'll soon find out...

You do not need a lawyer---or pay him off--  if they have been apart more then 3 years, she can file---if they haven't , why not wait it out, still live together.

Do you really need that? You might face similar problems—for example, your girlfriend might refuse to divorce you in the future. Just living together is enough. And no division of property

Essentially most of the replies are correct in some way.  Its a variable and complex situation.  But fundermentally if Thai hubby refuses divorces, he cann stall the divirce certificate for years.  Usually its for money.  Get a good Thai lawyer and have him negiotiate a 'break fee' with the ex.  Never run a dispute on principal, but always on practicality.

 

When there is a child from the first marriage involved, and mum (your G/F) wants custody, then as before Thai hubby will screw as much cash from you as he can.  There are lawyers in Thailand that specialise in screwing cash out of ferrang B/F.  Its just business.
