I was taken out by a foreigner, a middle aged woman.

I was riding my bike on a straight stretch of road (no intersection) she was performing a U turn, I T-boned her.


Both bikes have been impounded, her bike seems fine just broken plastic but my PCX is unrideable, the forks are pushed back into the engine, front light and plastic broken, it's a mess. 

 

Pattaya police came and we've been to the police station, they have said she is in the wrong. 

 

Once police release the bike I'm thinking of sending it to the Mityon service repair workshop Pattaya Tai, not far from the 7eleven big ship. 

 

How do I get her to pay to repair my damaged bike?


Anyone experienced similar?

Have you called the Insurance at time of the Incident? That's the most important part.

I had to go to the hospital.

 

Apparently she called her insurance company. 

I'm not sure if she was telling me the truth.

Get the policeman to help negotiate payment, he gets a cut. Hopefully you have her contact details. Lawyer up if you have to.

 

A better garage to take the bike is Klang, by 3rd road, they are always stripping bikes, boss guy speaks good English there and not a rip off

Is that the shop just up the road from the Testosterone clinic, same side of road Big C extra?

Yes just a hole in the wall, always very busy, look for the tall skinny thai guy in the back usually

Just so you know - that company has the largest motorcycle/scooter spares/parts stock in Pattaya (by a country mile) ...

Get a copy of her ID (passport), her driver’s license and her address, her license plate, her insurance company name and policy number. There maybe 2 insurance companies, one for the government mandatory insurance and another company for things the government policy doesn’t cover things like property damage. Get both companies’ names and policy numbers, this is critical to get a satisfactory settlement.

 

Do not sign anything written in Thai unless you understand and are fluent in Thai. Avoid believing a nonprofessional interpreter including the policeman and police interpretors and especially the insurance company agents. Before signing, get a certified interpretation into your home country language. Interpretors are certified by the ministry of foreign affairs.

 

Next, take your MC to an official authorized Honda dealer and make sure you get all official Honda genuine new parts. Tend to your injures at the best medical facility (Bangkok pattaya hospital)and keep all the official original receipts. Get wounds redressed and cleaned according to the doctor. The government insurance issuing company will pay all the medical bills, without question.

 

Ask for a reasonable sum for pain and suffering, loss of enjoyment, loss of wages, rental costs while your MC is being repaired and any other losses. Include your damaged clothing as property damage in addition to the bike.  

 

Thai insurance companies are famous for giving low ball offers.

 

There are ways to get what you want without involving a lawyer. The Thai insurance bureau that licenses insurance companies can help get a reasonable settlement, and also the small claims court can help, but you will need a trusted Thai language helper.

Very useful and precise tips, in practice hard to do all that, but must try..., 

 

The Google Translate has on camera translation that can help to get simple things quickly understood, of course no replacement for official translator... 

 

Also when you mention the government insurance pays for injuries, I assume this is when going to hospital, at that time , is it enough to show "my" compulsory insurance right there and get the treatment for free...? (up to 30k if not established whose fault). Do they need opposite side insurance too... 🤔

 

Or do you mean they pay us afterwards by presenting receipts...? I am not sure about this one...! 

 

I guess this is the same question with any extra insurance..., generally it's easier/better to get it before and not pay anything, but it would be good to know...
