Supreme Court Backs Trump’s Transgender Passport Ban

 

 

The Supreme Court has cleared the Trump administration to enforce its new transgender passport policy, allowing officials to list only an individual’s biological sex at birth and scrap the Biden-era rule that let Americans self-select their gender marker, including the “X” option for nonbinary people.

 

In a 6–3 partisan decision, the court’s conservative majority said requiring passports to display a person’s sex at birth “no more offends equal protection principles than listing their country of birth,” calling it a factual notation rather than discrimination. The ruling temporarily reverses a lower court order that had blocked President Trump’s policy while litigation continues.

 

All three liberal justices dissented sharply. Justice Ketanji Brown Jackson wrote that the court had “paved the way for the immediate infliction of injury without adequate justification,” warning the decision will have “real-world harms” for transgender and nonbinary Americans forced to carry documents that misrepresent their identities.

 

The Biden administration’s 2021 policy allowed passport applicants to self-identify their gender and, in 2022, introduced the “X” marker. Thousands used the option before Trump’s January executive order reinstated a binary definition of sex based strictly on anatomy, declaring it “not changeable.”

 

Civil rights groups have vowed to keep fighting the rule. The ACLU called the policy “discriminatory and baseless,” arguing that it unfairly targets a small, vulnerable group. Meanwhile, the White House defended the change, saying, “Private citizens cannot force the government to use inaccurate sex designations.”

 

Thursday’s ruling is not final — the Supreme Court will hear full arguments later this term. For now, the State Department can begin enforcing Trump’s restrictions, marking another major rollback of transgender rights during his second term.

This is objectively way too inflexible. There is no room for humanitarian exceptions. Consider a person with both genitals at birth and a decision is made to pick F when they could have just as easily picked M. Then a later time it's realized that was a mistake and the person feels to be male. Then he grows up male, presents as male, etc. While it's debatable whether X should be allowed, forcing such a person to have F as his ID is cruel and unfair punishment. Transgender people are in a similar boat now, but my example of those born with both genitals illustrates most dramatically how cruel this ruling actually is. 

There are two biological sexes: male and female.  To think otherwise is simply displaying insanity.

Of course, one can identify another way, as transsexuals do, which is fine, but the passport should have strictly medically verifiable data.

It's really simple............sex as indicated on the birf'in certificate is what goes on the passport, regardless of feelz.

 

In case of a birth defect where sex is indeterminate, they/them/those can petition their state to change their birf certificate, which should enable a change in the passport.

 

Would have to be supported by medical documentation, not just a passing whim.
