This (POR.161/162) applies to tax residents of Thailand.

it does not apply to non-tax residents of Thailand.

If you stay under 180 days in a calendar year in Thailand you are considered non-resident for tax purposes and can remit billions tax-free. Period.

It's not in my book, it's the law. Taxpayers are classified into “resident” and “non-resident”. “Resident” means any person residing in Thailand for a period or periods aggregating more than 180 days

For a starters Ukrules has said that I would have to pay tax in my situation, maybe read his posts again.

A few other members have also said I would have to pay tax.

I don't know your tax situation. From what I recall you put up a potential tax planning strategy? Refresh my memory.

The bottom line thou, is if you are NOT a Thai tax resident, then you do not pay Thai tax on foreign (non-Thai) income remitted to Thailand. That is in accordance and compliant with Thai tax law. A Thai RD slide was posted here clearly indicating this.

I recommend you carefully review this, as i believe you may have a serious misunderstanding ... You are not liable for Thailand tax, on foreign income to Thailand, if you are not a Thai tax resident. This is very fundamental.

@CallumWK ... you misread UKrules posts.

Look at this OFFICIAL chart, produced by the Thai RD. Look at the rows where the column for tax residency indicates in Thailand <180 days.

In BOTH (ie ALL) cases as a non-resident of Thailand, no Thailand tax. I think that is clear. ... Do you need further guidance to read that table?

@ukrules can you confirm what your stance is on this. Will I in your opinion have to pay taxes, or not, in the situation as laid out in the OP?

@oldcpu please stop spamming this thread, there is really no need to reply to 6 posts, one after another, to force your opinion on me. I heard it the first time.

Now guess who I believe, a member on an anonymous forum, or an auditor and a senior tax official?

There is only one thing to believe: the clearly articulated current written law.

IF you happen to be confronted by an authority who disregards the law, the sure thing to do is stand for your rights like everyone else should do (or use workarounds depending on the local context).
