Wife Bankruptcy - Falang Problem??

Hi guys,

I have a friend whos wife (villiage-marriage) went into bankrupcy for a year ago. Now

he is really scared to marry this wife for real at Amphue. Reason being that he is scared

that Thailand will take money from his pension to cover for the ladies bankrupcy??

Do anyone of you guys have any knowledge of this??

Appreciate all answers of course.

Agree, find a competent Thai lawyer who can give a clear, correct, specific answer.

Never forget that the law (all countries) covers hundreds of subjects and situations.

Because someone has a drgree in law doesn't mean they instantly have the correct answer to every situation.

And don't expect that a senior person at the local amphur office is an expert on any / all Thai law.

Thank you so much guys, highly appreciated... To the guy who said it was risky all over the world.. I can say that in my homeland Sweden, we devide people from people in our laws. i.e. my wifes sins and debths is never gonna be laid on me.. Her name on the debth her debth.... This was the ground why I was seeking information about this. Maybe Thailand have different laws.....

Who wouldn’t jump at the chance to marry someone who’s filed for bankruptcy? Clearly a flawless track record with money, what could possibly go wrong down the line? Honestly, sounds like top tier material. If he’s not interested, feel free to pass along my number. I’m ready to step in. Far better than some of the alternatives people usually warn you about like bar girls or ladyboys, right?

That's easy. Thankfully he is not already "officially married". A "village marriage" is meaningless before the law. All he has to do is await "bankrupcy proceedings" and await the outcome.

If he marries her before definite closure of "bankrupcy proceedings" are settled, he is a fool.

Check with AI such as Gemini, usually excellent with the law.

Sounds like the lady is bad with money, why would that not continue going forward once married? check with AI but likely husband is joint liable then

The Thai legal system does not accomodate AI. Especially not in the deepest of Isaan. I recommend my post above.

For sure. I don't see any way an experienced professional lawyer can be any better than any of the AN house armchair barristers. Complete waste of money to consult anyone else besides the AN Pub legal contingent.

Incorrect. My lawyer friend uses AI all the time, easiest way to check laws and cases

Me think if the husband and the wife kept their bank accounts and other financial dealing asperate he should be protected, but again T.I.T. better consult people in the know how to be sure to be sure to be sure.

i’m just wondering what personal bankruptcy looks like in thailand. was it a private individual or a business that went bankrupt? who was responsible for declaring her bankruptcy? did the village head do that? .... :-)

What a pity, but at least you aren't in the land of vertical smiles either right now. It is lovely along the Mediterranean. Perfect temperate spring time weather. T-shirt during the day and a pull-over on top at night.

5 years with her owning no property, vehicle or bank account then gone.

My wife had the same problem when I married her.

It's no big deal, and my wife got a mortgage loan 2 months after the time expired.

She'll get a letter every year asking for the money, but that's it.
