Hi all ..

1st post .

i've been a regular in LOS for serveral years having spent 6 of the last 12 months in thailand.

i now have a opertunity to live in thailand for the next 15 months at least .

41 years old , from UK

i have a LT thai GF for the last 18 months (not going to marry just for a visa thought so don't suggest that plz!!), living together in a house I own (if owning is what we call it lol)

company method 39% , company owns land , house leased to me .

i have been staying on a class O multi visa. toing and froing from UK and back with UK business intrests

i now wish to do something solely in thailand

namely property and land sales / rental.

its come about really fron just being there and knowing people, i;ve ended up with quite a list of people who want me to go legit and sell/rent condo's , hosues land etc for them .

so i'd like to do this legit really and get a litte office, get a WP etc .

i've looked at how to get the WP and seems fairly straightforward (lol)

but what i can't figure out is the trade of Real estate is it one of the restricted class's of empoyment and if so how do i do it .. nearly all real estate companies have farangs , they must start out as a small operation i guess with just the one farang, so not lots of thai employees to declare .

Congratulations, you've just figured out... the core of the problem in Thailand : massive fraud.

You're right : real estate is a no go for foreigners on 2 levels : work (WP) and company (Foreign Business Act).

Now, it's not because many people did it, that it's legal, right ?

Now, you could say : fair enough. But since nobody cares, or seems to care, I can do exactly the same.

That would be in a sense, in a way ... rational. :D

But, there is a but... Things change in Thailand since some time. A lot.

I would advise you to take infos on the amendment of the FBA, along with other datas about politics. You will understand that indeed there is a vast offensive against foreign interests and against the ways things were done in the past.

Furthermore, and I guess to achieve to discourage you (sorry !), the sector you have chosen is clearly not the best one, regarding the current situation of the thai economy and its perspectives on short and medium term.

In my humble opinion, you arrive too late. The party is about to stop.

But that's another discussion.

Many Farangs get round the WP rules by having a fancy sounding title like training Manager or Consultant, so most foreigners in the real estate business are styled as 'Consultant'.

BTW your cation mentions a one year WP. WP are only valid as long as you are allowed to stay in Thailand, so if you arrive with a non-imm B, you'll get an entry/exit stamp for 90 days, and any WP issued will only be valid until the exit date. Bit of a pain for those having to make a border run every 90 days. So it's important for you to get a one year extension (in your case based on married to Thai) ASAP, then your WP is POTENTIALLY valid for a full year.

so a WP as a property "consultant" is possible and legal then ?

would the company need thai employees as well , or is a one man band ok ?

and from my reading the procedure is as below .. am i right ?

1/ get class B multi entry from local consulate in UK

2/ get UK police record saying i'm not a criminal .

3/ travel to thaialnd on the B visa within 12 month of issue

4/ applie for WP and go thru all the hoops trying to get WP and visa dates to match

but then as a property consultant what can i do ,

can i take pepple legally to view properties or only supervise a thai employee to do it ..

can i even sit in a office legaly

i should add , i know that this may not make much if any money . it could make money but i'm not going to relie on it doing so.

we also have some very good thai freinds in the construction industry (houses/bungalows etc) who have been trying to break into the farang market, and would like to work with me on land/house projects, which hopefully will be of use. there building my house for me and a superb price.

the intention is get a shop (already seen one i like) for the GF to base herself in , she's a photoshop expert and has dreams of doing design and stuff , theres also a tie in with a good freind who does car and mc rental so 1 location and many things we can do .. most of which keeps me off the streets and doing something .
