Father : uk national, with Thai residence permit, no work permit

Mother : Japanese national, holding 1 year non-immigrant business visa, and work permit

Marital status : not married

Questions :

1. is child eligible for Thai nationality (father only holds Thai resident permit) ?

2. if not, what are the visa requirements for the child ?

3. can child obtain residency based on father,s residence status ?

Any help really appreciated.

1. If both of you are legal aliens in Thailand (which you both appear to be), your child can acquire Thai Nationality.

Bit hard to read but go look for "legal alien, legal alien, no, Thai" - the no refers to the status of the marriage, and the Thai indicates that the child is entitled to Thai citizenship.

I guess 2 and 3 are irrelevant. Congratulations :o

Congratulations on the new birth!

If you are a proper permenent resident with all the eveidence to go with that, then it appears to be the case that your child will be eligible for Thai nationality.

And why you want your kid to have Thai nationality? Brit and Japanese are working one with work permit, one has not, you two are not married and for more complication, you want your kid who born from none-married carries Thai? Help me to understand what you're trying to do? :o

I would think that in this case, the child could probably have 3 nationalities, Thai, British and Japanese. Be a tri-national.

my daughter has three nationalities, Thai, Australian and NZ. About to pick up her NZ passport today....

Thailand is our home, and we will raise the child here. Life will be easier if it also has Thai nationality as there will be fewer complications with visa\immigration issues.

May I ask what process you had to go through for acquire the Thai nationality for your daughter ? Does the hospital do this in the same way that they register the child's birth (at Samitivej) ?

I have a Thai passport, so it was a matter of when I was filling in the forms to state as much, also at Samtivej. As such, there was no applying. By acknowleging myself as Thai (and giving a copy of my Thai ID), he nationality was put down as Thai on her Thai language BC issued at the Ampur.

Given you are a permanent resident, I don't know the exact proceedure, but I'd suggest when you fill in the forms with hospital to submit all your PR documentation (ie PR book etc) as well as the blue Tabieen Baan which you'd have to be registered on. I'd ask to speak to the person at the hospital who liases with the ampur and nicely tell/insist/remind that the child is entitled to Thai citizenship given your PR status. And then I'd remind them again. This is due to the fact that cases like yours will be rare and they won't know the regs. Send back the BC if it comes back not stating your child has Thai nationality.

The other two citizenships had to be applied for, since being born overseas (in her case) didn't give to her other citizenships automatically.

If your child is male he is likely to have to serve his time in the Army too

plenty of legal ways around this, and one illegal one. Many of the former are just as easy as the latter.

FYI I met a guy born in BKK. Son of a European diplomat. Still had to get a visa 60+ years later. He said thais act like shit to foreigners no matter how long you stay.

Children of diplomats aren't entitled to citizenship. Their immunity allows them to remain immune from Thai laws, even the ones that could benefit them. I know quite a few farang-Thai's who were born back in the day where simply being born on Thai soil granted citizenship. Many of them live and work here, quite successfully.
