Please disregard if this has already been discussed here.

Reading in the Post the other day that the court in England is looking into the case in regards to the request Thailand has made for the extradition of Taksin.

Guess this is more a question for the Brits here.

I understand from the article that UK and Thailand have an agreement here.

So why is the court looking into the case when he is wanted in his own country?

Should this not be an easy case?

Would be interesting to see what will happen if UK NOT send him back.

I read weekly about westerners arrested by the police in this Country.

What will UK do if Thailand suddenly decided to keep all the arrested Brits in Bangkok Hilton, instead of sending them home (after partly served time), to finish the time back home?

After all, each time a westerner gets jail time in a non-western country, the Diplomats are knocking on the doors to have their citizens brought home soonest.

USA, as we know, is quite notorius when it comes to this.

The reason why the court is looking into this is because under UK law the courts decide if the case for extradition meets the criteria to allow an extradition to proceed.

Among the considerations are:

Would the crimes which are alleged be considered crimes in the UK? (if not no extradition)

If extradited and found guilty, is there a likelihood of execution? (If yes no extradition)

AND

Are the charges being brought politically motivated? (If yes no extraditon)

Even if the court does decide that an extradition can happen Thaksin would be entitled to appeal the court's decision.

Since Thailand has the death sentence and there are clear political issues here, I would be surprised if the courts rule in favour of extraditon.
