Hi

I'm new here so I don't know if this is the right forum to get this type of help.

My family and I are planning to visit Thailand in early April 2008. I am only going to stay 2 weeks. However my wife and 2 children are planning to stay 5 months.

My wife is a Thai citizen

My 2 kids are USA citizen. They are 1 year 7 months & 2 years 7 months.

I don't read the Thai laws very much and just found out the new PM don't allow unlimited 30 days Visas anymore. So now I need to fill out the correct paperwork for them to stay 5 months.

Any help or redirections would greatly be appreciated.

I assume you're all in US at the moment?

Can you get your kids Thai passports from the nearest Embassy?

If not then you'd best apply for a double entry tourist visa for them.

You'd likely get better results from families that have been in similar positions by posting this query in the Thai Visas section of the Forum.

Thai passport is the way to go. No need for any visas then. Also, kids that young cannot get overstay on non Thai passports I understand though their passports will be stampted as such, no fine is payable.

It is too late now to apply for Thai passports for the children. This means they should get a tourist visa in their US passports, then overstay. No fine for them, as Torrenova said.

US passports are easy. Thai passports are biometric, probably have to be produced in Thailand and sent back to the Thai embassy or consulate in the UK. In London, it took five weeks.

Wait a sec.... you mean to tell me my 2 kids can get Thai passports even though they were born in the USA?? If I knew this I would have applied long ago. As you can tell I haven't kepted up with Thai visa laws. Well what forms do I need to apply for a Thai passport for my kids? and can I pick them up in Thailand when I get there?

2nd of all, you mean to tell me my kids can over stay their Visa as long as they want without penatly fees or go to jail like adults??

3rd of all can my kids apply for a 1yr non-immigrant visa? what forms would I need? I did call my Thai Embassy in LA but nobody picked up and I left a message.

Maybe if your kids are here (in Thailand) for a while your wife can arrange to get them Thai passports here instead of there (US), then exit on Thai passports and no overstay stamp in the US passport, although no exit stamp either which may cause problems down the line?

A non-imm O should be possible with a Thai mother but I don't know if they'd still have to do border runs?

It is probably too late to organise the Thai Passports before you leave, but others have said, they should simply enter on their US passports. They'll be given a 30 day entry on arrival, but they won't be charged for overstay.

To get your children Thai passports, you'll need to contact the Thai embassy in Washington DC.

Given they were born in the US, but have claim to Thai citizenship (as well as US citizenship) they MUST apply for their Thai birth certificate through the embassy. This establishes their Thai nationality. Once the Thai birth certificate is issued, then it is possible for the embassy to organise the Thai Passport.

The reality is that embassy's process both Birth Certificates and the Passports at the same time. The next time they travel to Thailand, they can depart the US on the US passport, enter and then leave on the Thai passport, re-etner the US on the US passport.

As it stands this is incorrect advice.

As mentioned, the Thai birth certificate needs to be obtained first. This can ONLY be done by the embassy in Washington, as they are the only ones authorised to issue Thai birth certificates to Thai nationals born in the united states. As mentioned, the embassy can then process the passport.

If they chose to get their passports done in Thailand, they must first go to the Ampur and get their names put on the house registration where they mother is registered. Then they have to go to the passport office and get their passport done there.

For the first time round, I suggest getting everything done in the US as the easiest way to go.

Having a Thai passport for my USA kids sounds very interesting. I have some questions before I start applying.

1. Can my kids renew the Thai passport as long as they live?

2. Let's just say I got my kids a Thai passport. Which passport do I use when: a) leaving USA, b)entering Thailand, C)leaving Thailand, d)entering back to USA? If I leave with a Thai passport from the USA and come into the USA with a Thai passport, am my kids going to need a Visa? and if my kids are 18 years old, if they leave USA with a Thai passport and return to the USA with a Thai passport, I'm really sure USA will deny them as they will forsure need a Visa even though they were born in the USA. Unless they allow to carry both passports, but which one will be stamped?? This can get really confusing.
