It doesn't appear to be the Hilton.

I looked at the site (Klong Prem Central Prison), and had to chuckle at a list of things prisoners weren't allowed to take with them to prison, some of which were...

  • escape equipment
  • explosives

(glaring omission: pastry boxes)

...amazing that some things really have to be written out. I hope they post this list at the entrance of the prison, just in case any officials forget what's hot & what's not. :D

Has anyone any idea what criteria is used to decide on who goes to which prison.

Could this be a facility for the chosen few i wonder as " special prison smacks of elitism " based on a certain station in life,

Even priviledged in criminally convicted are they.............<deleted>

marshbags :o

Couldn,t see the room options or tarifs toptuan :D

Which of these two accommodations do you think Peeshit will be sequestered in? :D

Definitely none of the above! You surely don't even begin to think that Thai prisons have beds do you???? And individual rooms? You're having a laugh! They lie sardine style - pity the guys who end up by the open toilet :D - on thin mattresses which are made within the prison......

Marshbags,

At that particular prison site, there are two prisons for men:-

1) Bangkok Remand Prison (also known as Bangkok Special Prison)

2) Klong Prem Central Prison

Usually prisoners who are awaiting sentencing are held in Bangkok Remand prison. Also, when prisoners are first sentenced - usually with a sentence of 3 years or below - they are held in Bangkok Remand. However, IF there is overcrowding....., they may be transferred to Klong Prem Prison. Transfers seem to happen twice a year in June and September with no warning.

Generally, prisoners with sentences of 3 years or more will be taken to Klong Prem Central Prison.

As the lawyers above have, to date, only received a 6 month sentence, it is logical that they would be held at Bangkok Remand Prison.

N.B. People who are being held awaiting extradition are usually held in Bangkok Remand Prison. (As I understand the Russian guy is for example).

As a rule, Bangkok Remand prison allows daily visits (Monday to Friday) but just once a day. Whereas, Klong Prem Prison allows fewer visits perhaps only once or twice a week (This depends upon the building number the prisoner is held in and can also depend on the crime committed).

Hope that clarifies things!

(NB. If interested in reading further you may wish to check out this website http://www.phaseloop.com/foreignprisoners/...s-thailand.html - it is more up to date re: visits etc than the Official Thai Correctional Dept's website detailed on an earlier post.

Now come the official bribery charges...

Supreme Court files charges against 3 lawyers

Director of the Supreme Court's Administration Office Nutcha Worawattanmaetikul was tasked today by the Secretary of the Supreme Court Anun Wongpraparat to file charges against three lawyers of former Prime Minister Thaksin Shinawatra, including Pichit Chuenban, Miss Supasri Srisawas, and Thana Tunsiri.

The three will be charged with bribing a government employee inline with Article 144 of the Criminal Law.

*Cue slimdog to post the specifics of the Article? He's always seems so good at that sort of thing* :o

The three are involved in the case in which a dessert container was delivered to Supreme Court employees containing 2 million baht inside. The case will be filed based on a court order.

An investigative officer stated that the collecting of evidence in the case should be completed within 30 days and an arrest warrant should be issued within that time. *well, at least we know where there'll be then so they should easy to serve with their warrants*

The whole talk reminds me the chinese word : "When a finger points to the moon, the imbecile looks at the finger"...

Let's recap, with some keywords, this famous "pastrygate" :

-Thaksin

-Supreme Court

-Ratchadapisek land case (bought for around 770 millions THB)

-2 millions THB in a bag

-bag given by the lawyers inside the building

Wich items look definitely out of the picture ?

:o

Do you seriously believe that :

-2 millions would do the trick to bribe the Supreme Court ? I mean it would be a tip. A tip for the maid !

-that Thaksin would be stupid enough to ask his own lawyers to bring and give the bribe inside the Court building ?

But no, no one is shocked... Even by thai standards (high creativity and black humor) this story is surreal.

Thaksin denies involvement in alleged attempt to bribe court official

BANGKOK, June 26 (TNA) – Former prime minister Thaksin Shinawatra categorically denied he was alleged to be involved in the attempted Bt2 million bribery at the Supreme Court following Wednesday's verdict to send one of his lawyers and his aides to a six-months jail sentence.

Speaking on behalf of the ex-premier, Pongthep Thepkarnchana said that Thaksin had dismissed all possible involvement in the alleged attempt by his lawyer, Pichit Chuenban and his aides, Suphasri Srisawat and Thana Tansiri, who were earlier assigned to fight the Bangkok land lawsuit on Thaksin's behalf and alleged to have attempted to bribe a court official.

Pongthep said his boss had offered to appear on the witness stand during a court trial in the Bt2 million bribery case which is to be filed against his own lawyer and his aides.

Thaksin will by no means question the Supreme Court verdict which delivered the six-month jail term for his men. "Thaksin respects the court's decision and expresses his regret over the incident," said the former premier's personal spokesman.

The ex-premier had returned to Thailand with intent to fight for justice over varied wrongdoing and abuse-of-power charges and never entertained the idea to get involved in such alleged bribery attempt, Pongthep said.

The ex-premier's personal spokesman said his employer had no interest in the alleged bid to bribe such a low-ranking official at the Supreme Court, namely ML Thitiphong Chomphunut, who was by no means authorised to pass judgment on any lawsuit.

Pongthep said no other lawyer will be assigned to replace Pichit who is currently being detained alongside Suphasri though the Bangkok land lawsuit is pending court proceedings.

Thana, who had allegedly handed out the kickback money prepared in 1,000-baht banknotes in a snack box to the court official, saying it was just a pack of chocolate, is yet to be arrested and brought to justice.

Pongthep said Thana had not escaped arrest as earlier feared and was being under medical care at a private hospital in Bangkok.

Waste of a thread, waste of this post I suppose. Why do you lot even bother with this stuff. Nothing will change. If you are just trying to have a bit of fun, then O.K. I'd hate to think anyone was seriouly questioning morality or ethics concerning Thai politicians, or the prospect of any changes that would give a self-satisfied smile to foreign Thai "observers". Ain't goonna happen -we all know that.

Thana Tansiri, is found to have been recuperating from excessive stress at Bumrungrad Hospital. He has asked the court for a period of seven days to recuperate from his illness. Two police officers have been stationed at his hospital room door, 24 hours to prevent him from fleeing as there were earlier speculations that he has fled the country. Thana is also said to be a relative of Thaksin's wife.

and just like clockwork, in addition to the one in hospital hoping to evade being thrown into the brig due to strees, the two that are in prison are complaining that... "Hey, It's stressful in here. Let us out.".... :D

Sleepless night in jail

Two imprisoned lawyers said to be suffering stress from incarceration

Pichit Chuenban, convicted of violating the court's authority, spent a "sleepless" first night in jail. Pichit, who has worked as a lawyer for 30 years, told relatives and friends who visited him yesterday morning that he was depressed and could not sleep.

The Supreme Court on Wednesday sentenced three lawyers - Pichit, Thana Tansiri, and Supasri Srisawat - to six months in jail for violating the court's authority for their involvement in a case in which a court official was given a bag filled with Bt2 million in cash.

The three are lawyers of former prime minister Thaksin Shinawatra and his wife Pojaman, who have been charged with abusing their power in purchasing a plot of land in Ratchadaphisek area.

A relative told reporters that Pichit appeared in a prisoner's uniform, light blue shirt and blue trousers, and looked sad when he saw his visitors weeping. :D

"It is not fair to me. If I really did it, I would not complain," the same relative quoted Pichit as saying. :D

Songwut Wattanakul, Chief of the Bangkok Special Remand Prison, said Pichit was quite stressed and he had advised prison officials help him adjust to prison life. *Those caring, gentle, kindly, thoughtful, and understanding prison guards I'm sure can "help him to adjust* :D

"We may ask Pichit to use his legal expertise to help the prisoners," Songwut said. :chessy:... *great idea, Warden... but just don't let him pull a Shawshank Redemption on ya....*

Supasri, who has been jailed in the Central Prison for Women, is reportedly sick as a result of stress. The prison will send a psychiatrist to talk to her. *don't send a doctor, send Samak over... he's got experience with mental illness*

Supasri also has kidney disease and if she shows symptoms will be sent to the Corrections Hospital, said Corrections Department Chief Wanchai Rujanawong. *Just make sure she uses the same medical facility as the Farang Prince did.* :D

Farang Prince Dies In Thai Jail

Meanwhile, the Supreme Court yesterday filed a complaint with the police, accusing the three Thaksin lawyers of bribing officials. Sarawut Benjakul, Deputy Secretary-General of the Justice Affairs Office, said a court official had already sought legal action against Pichit, Thana, and Supasri with the Chanasongkram district police.

Thana, who was not present at the Supreme Court on Wednesday, is now under police custody in Bumrungrad Hospital, where he had admitted himself for treatment, Thaksin's spokesman Pongthep Thepkanchana said.

The police issued an arrested warrant against Thana, who is married to Pojaman's cousin, and blacklisted him from travelling overseas. :o

This whole episode has all the ingredients for a Monty Pythonesque story. One can almost imagine John Cleese and Michael Palin arguing over what was actually in which bag. Chocolates or cakes or money?

Then having a discussion and argument over prison conditions etc.

Maybe Thailand's government can create a "Ministry of Silly People". Headed by......................................? :D

Perhaps some of the wits on this board can be a little creative?

After all if this whole thing wasn't so serious it'd be hilarious. :o

OVERDRIVE

Would the owner of the pastry-box 'bribe' please step forward?

By Thanong Khanthong

The Nation

Published on June 27, 2008

It might end up as a case of "pla tai nam tuen" (a fish dies in shallow water).

This old Thai saying means that a careless and minor blunder can bring about a fatal casualty. It perfectly fits the situation that ousted prime minister Thaksin Shinawatra is now facing.Three of Thaksin's lawyers were found by the Supreme Court to be guilty of contempt of court after allegedly attempting to bribe court officials with Bt2 million stashed in a pastry package. Pichit Chuenban, Suphasri Sriswat and Thana Tansiri were sentenced on Wednesday to six months in prison on the contempt of court charges. Pichit and Suphasri were taken to jail immediately. Thana is now undergoing medical treatment at Bumrungrad Hospital. But the police are putting him under custody.

The Supreme Court has also pursued a separate bribery case against the three defendants.

Thaksin and his wife Khunying Pojaman will be deprived of this legal team when the Supreme Court's Office of Political Holders starts a hearing into the Ratchadaphisek land deal on Monday. Pichit is a veteran lawyer, while Suphasri is a law clerk and Thana is a legal coordinator. Thana is married to a niece of Khunying Pojaman. (NMT: :D How can you have a lawer and/or legal coordinator in your family and represent you in the court? Will the courts believe you? )

Thaksin and Pojaman have been accused of abusing their power when Pojaman entered into the bidding to acquire a plot of land in the Ratchadaphisek area of Bangkok, auctioned by the Financial Institutions Development Fund. Thai law requires a spouse to approve a legal transaction. Pojaman won the bidding and Thaksin used his identity card as prime minister issued by the Prime Minister's Office, to back the legal transaction.

Thaksin spokesman Phongthep Thepkanjana earlier called the alleged bribery incident "a joke". But yesterday he issued a statement on Thaksin's behalf, saying that Thaksin expressed his regret over the Bt2-million bribery case and denied that he had anything to do with it. Phongthep also said Thaksin is willing to testify to the court regarding this case if asked to do so. (NMT: so kind of him, to take his time, for such small maters :D )

On the day of the incident, Pichit, Suphasri and Thana went to the Supreme Court in order to facilitate matters when Thaksin and Pojaman went to report to court officials after returning from abroad. Thana was the one who handed over the "snack box" to a court official. They opened it up and found Bt2 million inside. They took pictures of the money and consulted their superiors. They called Thana in and asked whether he knew what was inside. Thana nodded his head. They gave the money back to him. During that time Thaksin and Pojaman were reporting to court officials. Thana took the snack box of money and handed it over to Pol Lieutenant Wathanyu Wittayapalothai, one of Thaksin's guards, who stored it in a car. (NMT: :o !!)

The Supreme Court found that Pichit, Suphasri and Thana were acting as part of the same team because they were talking to each other throughout the day. The court did not believe Thana was acting alone. Thana tried to defend himself by saying that it was a misunderstanding. He intended to give a box of chocolates to court officials, but his driver brought him the wrong package, one with Bt2 million that had been gained from a land sale. The money was about to be deposited in a bank, he said. The Supreme Court did not buy this. (NMT: easy follow up the alleged land sale. Bring the withness who handed over the money, and show the records of the withdrawal !!)

Now that the Supreme Court has asked the police to further pursue the bribery case against the three defendants, will the investigation cover other characters? The Supreme Court's ruling showed that Thana handed over the package with the money in it to Wathanyu, Thaksin's personal guard, so that it could be stored in the car.

The ultimate question is who really owned that Bt2 million. The Supreme Court's verdict has already suggested that it was used in a bribery attempt. If this is the case, then the investigators will need to find out who owned such a large amount of money. A lawyer would never use his or her own money for the purpose of bribery. Once this bribery case goes to court, it will prove to be another big twist in the course of events.

TALK OF THE TOWN

Jailhouse lawyers

Published on June 27, 2008

The news that Thaksin's lawyers had been ordered behind bars - and details of the court ruling- dominated the headlines of nearly all local newspapers.

In fact, one of the former lawyers of Thaksin who had been convicted was still missing as of press time. The news of Thaksin's lawyers being jailed managed to knock the ongoing debate about Preah Vihear from the headlines. Thai Post ran an editorial urging the court to trace the source of the Bt2 million. "Is it possible that a lawyer would make a big sacrifice which does not relate to the interest of the case?" asked the paper.Still, the debate on Preah Vihear continued in several papers. Matichon said the debate on the issues shows the beauty of the parliamentary system as at least the House debate has cooled political temperatures by turning attention from the street protests to the House.

Matichon's editorial was titled "Benefits of the House". It said the debate in the Upper House and Lower House is a part of legislators' duty to check the performance of the administrative branch.

This censure debate occurred at a time when political temperatures were rising largely due to the protest held by the People's Alliance for Democracy (PAD). Prime Minister Samak Sundaravej questioned the legitimacy of PAD by asking who elected the group to power. PAD responded by saying street protests were a part of civil politics. Now that the focus has returned to the House, the government and House MPs have a forum in which they can prove their worth.

Matichon said there are certain benefits from the House debate. The comments raised during the debate should be beneficial to the administration. Therefore, the government should learn how to acknowledge its mistakes.

Nonetheless, Matichon noted voting in the House is a weakness in the system because chances are that MPs from the coalition parties will vote to support the government, regardless of the content of the debate or the public's response.

Matichon said MPs should thus think matters through by considering feelings of the people. After they have listened to the debate, what will they think if the coalition parties' MPs all voted to support the prime minister and the ministers under scrutiny, even though they had failed to answer several charges?

Matichon summed up by saying the political temperature at this point is high largely because of the Preah Vihear controversy. While accusations continue, the politicians should play a vital role in fostering unity in society and solving problems facing the country. Otherwise, the House would be nothing more than a forum for a war of words where the good of the people has no place. Voting, or abstention from voting, thus means a lot in terms of the credibility of the House in the eyes of society.

pop quiz #582

Name one public announcement by ex-PM THaksin, in the past 10 years, that was not a lie.

I think he's being honest here:

Thaksin nominates Newin to head drug war investigation

Deposed, demoralized ex-, former, previous, and prior temporary caretaker PM Thaksin Shinawatra put forth the name of his associate and former TRT Party member Newin Chidchob to head the drug war investigative panel. "I've not met a more honest official," Thaksin was quoted as saying. "He'll be impartial and unbiased in his probe." "I have it on good authority that Newin's involvement in the drug trade was on a high level which should enable him to closely examine the inner-workings of what happened," Thaksin elaborated.

Thaksin plays it carefully

Former premier Thaksin Shinawatra on Thursday supported the court decision to jail his lawyers for attempted bribery, and said he would continue with his own trial on corruption charges.

"I am ready to defend my case in the court of justice," a statement quoted Mr Thaksin as saying.

On Wednesday, Mr Thaksin's lead lawyer and two aides were imprisoned for six months for attempting to bribe a Supreme Court judge with a candy box stuffed with two million baht.

T is going after another statue of limitations verdict, more postponements due to new legal team being found, brought up to speed and new motions etc etc. We were told he was found guilty of telling a little lie durng courtroom statements he made during a law suite filed by his ex US partner. Although guilty, the statue of limition had expired on perjury in that case. When your on a run stay with it. Too bad someone does not trip him real hard.

Well, it wasn't a bribe to judge, it as a gift to a couple of court clerks, 2mil seems to be impressive enough for their salary level.

Was is a stupid move? Are you sure it was the first time? Are you sure it hasn't worked before with some other court staff?

Even a simple clerk doing photocopying can be a source of valuable information.

What do we know so far?

The Nation:

Quote

Thana had argued in his earlier testimony that it was a mistake, as his driver got the wrong box for him to deliver to the court official.

The "wrong" box contained money intended for a land purchase, while Thana's wife was said to have filled another bag with chocolate candy.

and later we hear:

Quote

So the money came from a "land purchase" handed over by his driver, to the court. Thana acknowledged that he knew that their was money inside,

and once he received it back, hand it over to Thaksin's guard Pol. Lietenant Wathanyu Wittayapalothai.

So the question is, who exactly is this Pol. Wathanyu Wittayapalothai (apprantly Thakins's guard)? And why did the money came from the driver, via non-acceptance at the court, back to Thaksin's people? Why not lock/interrogate immediately this 2 further suspects (which seams to be clearly closer to the source of bribe)?

If they claim it was from a land purchase, why not check also check the source, based on their statements?

Very interesting case, and could change the political landscape very soon.

I've been curious as to why on Earth anyone in their right mind would place that amount of money, intended for a land purchase, in a pastry-box to begin with. The story reeks of corruption.

Peeshit in more deep do-do...

Pichit faces being delisted as lawyer

The Law Society of Thailand will today meet to decide on the punishment against Pichit Chuenban, lawyer of former prime minister Thaksin Shinawatra who was sentenced to six months in jail for contempt of court over the attempted bribery allegation.

Sithichok Srichok, Chairman of the LST Ethics Committe said 15 LST board members will meet in the evening on the case.

He said Pichit is expected to be delisted from the LST and banned from being a lawyer for five years. He said from the LST record, few lawyers who were delisted were allowed to be listed again.

He said Pichit committed a grave offence and all LST lawyers could not accept the practice. He said lawyers have duty to protect not only their clients' interest but maintain the justice system.

Feined death and escaped with a bed sheet over his head ?

Next they smuggle in a look alike to Thana's hospital room who is then found dead from "stress" the next morning letting the real Thana off the hook and prompting the release of the other 2 lawyers in prison due to compassionate grounds and the potential of death from "stress".

Anyone care to write the next chapter ?
