Dear All,

I'm :

a Brit

Living in Thailand for 5 years

Been Living with Thai GF 4 years

We Have 3 kids together

Neither of us ever married before. and we are not married.

She's a student, I have 2 Thai companies, one owns land, one owns a few apartments.

She is not listed as shareholder or director in either company.

She is on my blue book for one apartment.

Questions:

So if we were to split up, what is she entitled to ?

In Thailand and in England...

I'd happily pay support for our kids, would even like custody..chances ?

Also read common law wife status exists after 7 years in Thailand ...True ?

Legally she is not entitled to anything, but you have to support your kids. The courts may assign an amount if you go that route. but the right things is to continue supporting the family you created, regardless of the law

As to custody, you would first ned to be sure you already have joined cutody with the mother. You only have joint custody with the mother if you rgistered the birth of each child yourself at the amphur. If anybody else registerd the child at the amphur, than lagaly you are not the fasther and don't hold custody over the child. Being named on the birthcertificate as the father is of no consequence, since you are not married only the fact if you registered the child yourself is important.

It all depends?

Are your companies strictly legal, or are you one of those behind the scenes illegal owners of property in Thailand?

If not 100% legit, than your girlfriend could cause you big problems as regards to payoffs and support.

As far as I know, live in girlfriends are not classified as common law spouses in Thailand. But anything including vehicles, land, property, monies and chattels etc in her name, by law are regarded as gifts and you have no claim to these.

As for your children, you will have to consider applying to the court for custody if this is what you want. Otherwise she could take you to court for custody of the children and child suport, only unlike in the UK, she can not be assisted by legal aid and would need to finance her own legal fees, plus in Thailand the legal process could drag on for years.

Again, it all depends if during your 5 years stay here in Thailand, you have conducted your business dealings 100% legally as imposed by Thai law, otherwise she could, so to speak, take you to the cleaners.

AGREED, hence why I wrote : I'd happily pay support for our kids, and and expect to support her too !
