My now wifes fiance visa expired 3 months ago . If & when FLR is granted will start date be backdated to

fiance visa expiry date ?

FLR application was submitted 14-15 weeks ago. The UKBA have just requested evidence in the form of

documents/official letters to prove cohabitation for the last 4 months. Acceptable documents from GP,

hospital,government depts,Bank statements/savings books, utility bills,phone bills etc. These to be addressed to my wife or preferably jointly.She has none of these except GP medical which she has forwarded with covering letter .

If FLR is backdated my wife will have been in UK 4-5 months after fiance visa expiry before she lays down roots. Open joint bank accounts,Jointly name utilitys,mobile phone contract etc . How might this 4-5 months lack of cohabitation proof effect the next FLR/ILR application ? Thoughts please

Her FLR will start from the date of issue, as her previous leave will have been extended until the FLR is issued.

As you say, when she applies for ILR (or FLR if she hasn't satisfied the KOL requirement) she will need to provide documents to prove cohabitation as you described covering the whole two years of the FLR. You wont need any documents from before the start of her FLR; they would have accepted that you were cohabiting for that period or they would not have issued the FLR.

Although she could not work while on a fiance visa, she could have, and can now, open a bank account, joint or otherwise, register with the doctors, be put on your utility bills etc. So you should start organising that now. Although some may not be possible until she gets her passport back.

Thank you 7by7. i was really hoping you would respond to my post . As you say we could have set up joint

utilities, opened joint bank account prior to surrendering passport etc. However i thought to myself am i really to expect the CO to 100% believe my wife would return to her homeland in the event of refusal if we had laid down roots pre-empting a positive ruling .Or come across as overly confident. Catch 22
