Hi- I have an America with an O-A Visa that expires on Dec 27. I return to Thailand on Dec 29. I have a return flight, original income documents showing 2,ooo,oooBAHT income. a home in Bangkok. If I send this to the New York Consulate with a request for an additional year, will they do it? Do I need to send another $175. I have a Receipt of Notification from 14 October, 2009. Do I need to do anything at all? OR should I just return to BKK on Dec 29 and use that entry for staying another 3 months? My feeling is that I just go to BKK without doing anything. Do you agree? Thanks- John

An OA visa never gets a 3 month stamp and if it expires before arrival you get nothing. What exactly do you have? What do you want? Why do you want it? Sorry - but your post is very unclear.

If you have a return flight to US it does not appear you want to stay in Thailand (but you mention a home in Bangkok).

An OA visa requires a police report/medical/age over 50/financial proof and application/money. Any item missing it will not be issued. It is issued for retirement in Thailand.

1. When you return on December 29th your 'O-A' visa will be expired and not valid for entry into Thailand.

2. You cannot renew the visa (get an additional year); however, you can apply for a another 'O-A' visa from New York. Yes you have to pay the fee!

3. Next best option would be a non-immigrant 'O' visa, multiple-entry if they will issue, and then get an extension of stay based on retirement from immigration in Thailand. You would need to qualify for the retirement extension and have your financials already in place in Thailand if you only can get a single-entry visa, timing can be crucial when getting an extension.

4. You should have some kind of visa before boarding the plane.

5. Receipt of Notification sounds like a 90 day address report, not relevant to visa issues.

If you can change your arrival date to Thailand to the 26th of December you will receive a permit to stay until December 25th of 2010

If you don't then you must submit new documentation to the New York Consulate, pay the $175 fee (they would not issue me a single entry O-A in October) and get a new Visa

I would urge that you use their web site to obtain the forms since there is a minor difference between NY forms and the Embassy in DC's forms, they accepted them from me but requested that I use their forms next time

If you are near to NYC and go there in person they will give you next day service. Submit your forms and documentation between 9-12 PM one day, and receive your Visa the next day after 1:30 P.M.

"If you can change your arrival date to Thailand to the 26th of December you will receive a permit to stay until December 25th of 2010"

Isn't that only true if he has a multiple entry O-A?

Also, the date he gave as the visa expiry date might actually be his permitted to stay date. It's highly unlikely that his visa date and permission to stay date are the same. It's possible his visa expired long ago.

As noted above, more info needed.

I usually try to guess what the poster is saying when it is unclear. This time, I agree with the others, guessing is a waste until the OP posts more clear information. For example, his first sentence. Is he talking about expiration of the date to first use a visa or expiration of his current permission to stay in Thailand?

The OP received a reply based on the info posted. Agreed, the posted info is rather ambiguous; however, the underlying fact his that the OP needs a new visa to get back into Thailand on 29th December. Whatever he has is irrelevant, it expires on 27th December.
